Senate Study Bill 1021 - IntroducedA Bill ForAn Act 1repealing the Missouri river preservation and land use

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 456A.14, Code 2021, is amended to read
2as follows:
   3456A.14  Temporary appointments — peace officer status.
   4The director may appoint temporary officers for a period
5not to exceed six months and may adopt minimum physical,
6educational, mental, and moral requirements for the temporary
7officers. Chapter 80B does not apply to the temporary
8officers. Temporary officers have all the powers of peace
9officers in the enforcement of this chapter and chapters 321G,
10321I, 456B, 461A, 461B, 462A, 462B, 463B, 465C, 481A, 481B,
11482, 483A, 484A, and 484B, and the trespass laws.
12   Sec. 2.  Section 456A.24, subsection 12, Code 2021, is
13amended to read as follows:
   1412.  Adopt rules authorizing officers and employees of the
15department who are peace officers to issue warning citations
16for violations of this chapter and chapters 321G, 321I, 350,
17456B, 457A, 461A through, 461B, 461C, 462A, 462B, 463B, 464A,
18465A through, 465B, 465C, 481A, 481B, 482, 483A, 484A, and
19484B.
20   Sec. 3.  Section 461A.78, Code 2021, is amended to read as
21follows:
   22461A.78  Method not exclusive.
   23This subchapter shall not be the exclusive method for
24establishing a water recreational area and shall not be
25construed to prohibit the establishment of public recreational
26areas by the Missouri river preservation and land use authority
27under chapter 463B
.
28   Sec. 4.  Section 481A.1, unnumbered paragraph 1, Code 2021,
29is amended to read as follows:
   30Words and phrases as used in this chapter and chapters 350,
31456A, 456B, 457A, 461A through, 461B, 461C, 462A, 462B, 463B,
32 464A, 465A through, 465B, 465C, 481B, 482, 483A, 484A, and 484B
33and such other chapters as relate to the subject matter of
34these chapters shall be construed as follows:
35   Sec. 5.  REPEAL.  Chapter 463B, Code 2021, is repealed.

1   Sec. 6.  TRANSITION PROVISIONS.  Any moneys remaining in
2any account or fund under the control of the Missouri river
3preservation and land use authority shall be transferred to the
4general fund of the state on the effective date of this Act.
5EXPLANATION
6The inclusion of this explanation does not constitute agreement with
7the explanation’s substance by the members of the general assembly.
   8This bill repeals the Missouri river preservation and land
9use authority (authority).
   10Currently, the authority exists to engage in comprehensive
11planning for and the development and implementation of
12strategies designed to preserve and restore the landscape
13adjacent to the Missouri river. The authority is required to
14work with interested parties in developing plans and proposals
15and conducting public hearings relating to the conservation,
16preservation, and acquisition of land adjacent to the Missouri
17river. The authority also administers the Missouri river
18preservation and land use fund in order to further the purposes
19of the authority.
   20The bill repeals the authority and makes conforming changes
21to the Code. Upon the effective date of the bill, any moneys
22remaining in any account or fund under the control of the
23authority shall be transferred to the general fund of the
24state.
