Senate Study Bill 1019 - IntroducedA Bill ForAn Act 1relating to notification of the general assembly
2concerning certain state government leases and real property
3acquisitions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  7E.5B  Real property lease or
2purchase — notice.
   3In addition to any other provision of law, any purchase or
4lease of real property, other than on a temporary basis, when
5necessary in order to implement the programs of an authority or
6protect the investments of an authority, shall require prior
7written notice from the authority to the legislative services
8agency. The legislative services agency shall submit the
9notification to the government oversight standing committees
10of the general assembly. The notification shall include the
11information as described in section 8A.321, subsection 16.
12   Sec. 2.  Section 8A.321, Code 2021, is amended by adding the
13following new subsection:
14   NEW SUBSECTION.  16.  At least thirty days prior to entering
15into a contract for a lease or renewal of a lease pursuant
16to subsection 6 or a contract for the acquisition of real
17property pursuant to subsection 9 in which any part or the
18total amount of the contract is at least fifty thousand
19dollars, notify the legislative services agency concerning the
20contract. The legislative services agency shall submit the
21notification to the general assembly’s standing committees on
22government oversight. The notification is required regardless
23of the source of payment for the lease, renewal of lease, or
24acquisition of real property. The notification shall include
25all of the following information:
   26a.  A description of the buildings and office space subject
27to the lease or renewal of lease or a description of the real
28property to be acquired.
   29b.  The proposed terms of the contract.
   30c.  The cost of the contract, including principal and
31interest costs. If the actual cost of a contract is not known
32at least thirty days prior to entering into the contract, the
33director shall estimate the principal and interest costs for
34the contract.
   35d.  An identification of the means and source of payment of

   2e.  An analysis of consequences of delaying or abandoning the
3commencement of the contract.
4EXPLANATION
5The inclusion of this explanation does not constitute agreement with
6the explanation’s substance by the members of the general assembly.
   7This bill establishes notice requirements relating to
8certain leases or purchases of real property by the department
9of administrative services or executive branch authority.
   10New Code section 7E.5B requires an executive branch
11authority to provide prior written notice to the legislative
12services agency for submission to the general assembly’s
13standing committees on government oversight information for any
14purchase or lease of real property, other than on a temporary
15basis, by the authority when necessary in order to implement
16the programs of the authority. The bill provides that the
17notification shall include the information as required by the
18bill for the department of administrative services.
   19Code section 8A.321, concerning managing the physical
20resources of government, is amended to require the director of
21the department of administrative services to notify and provide
22to the legislative services agency for submission to the
23general assembly’s standing committees on government oversight
24information regarding entering into a contract for a lease or
25renewal of a lease for certain buildings and office space or
26a contract for the acquisition of real property in which any
27part or the total amount of the contract is at least $50,000.
28The bill requires the notification at least 30 days prior to
29entering into a contract and provides that the notification
30include information describing the buildings and office space
31subject to the lease or renewal of lease or describing the
32real property to be acquired, providing the proposed terms of
33the contract and the cost of the contract, identifying the
34means and source of payment of the contract, and analyzing the
35consequences of delaying or abandoning the commencement of the
