2public employee collective bargaining units conducted by the
3public employment relations board.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 20.15, subsection 2, Code 2021, is
2amended by adding the following new paragraph:
3 NEW PARAGRAPH. c. The board shall only conduct an election
4pursuant to this subsection if the board has not previously
5conducted such an election for the bargaining unit since the
6last certification election pursuant to subsection 1 conducted
7by the board for that bargaining unit.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11Current law provides that the public employment relations
12board shall conduct a retention and certification election
13prior to the expiration of a public employee collective
14bargaining unit’s collective bargaining agreement.
15This bill provides that the board shall only conduct
16a retention and certification election for a collective
17bargaining unit if the board has not previously conducted such
18an election since the collective bargaining representative for
19that collective bargaining unit was certified.
