Senate File 48 - IntroducedA Bill ForAn Act 1relating to golf cart operator exemptions from the
2state driver’s licensing requirements, and making penalties
3applicable.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.176, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  03.  Any person with a physical or mental
4disability while operating a golf cart on a city street
5pursuant to section 321.247 if the governing body of the
6applicable incorporated area does not require the person to
7possess a valid driver’s license in order to operate the golf
8cart on city streets.
9   Sec. 2.  Section 321.247, subsection 1, paragraph a, Code
102021, is amended to read as follows:
   11a.  Incorporated areas may, upon approval of their governing
12body, allow the operation of golf carts on city streets by
13persons possessing a valid driver’s license or by persons
14with a physical or mental disability who do not possess
15a valid driver’s license so long as a person possessing a
16valid driver’s license is in the golf cart while it is being
17operated
. However, a golf cart shall not be operated upon a
18city street which is a primary road extension through the city
19but shall be allowed to cross a city street which is a primary
20road extension through the city.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24Current law permits the governing body of an incorporated
25area to allow the operation of golf carts on city streets
26within the incorporated area by persons possessing a valid
27driver’s license. This bill permits the governing body
28of an incorporated area to allow a person with a physical
29or mental disability who does not possess a valid driver’s
30license to operate a golf cart so long as a person possessing
31a valid driver’s license is in the golf cart while it is being
32operated. The bill exempts persons with a physical or mental
33disability from driver’s license requirements while operating
34golf carts if the governing body of the applicable incorporated
35area does not require the person to possess a valid driver’s

   2A person who violates Code section 321.247 commits a simple
3misdemeanor punishable by a scheduled fine of $135.
