Senate Study Bill 1015 - IntroducedA Bill ForAn Act 1relating to the sex offender registry including
2duration of registration requirements and sexually motivated
3extortion.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 692A.102, subsection 1, paragraph c,
2Code 2021, is amended by adding the following new subparagraph:
3   NEW SUBPARAGRAPH.  (033)  Extortion in violation of section
4711.4, if a determination is made that the offense was sexually
5motivated pursuant to section 692A.126.
6   Sec. 2.  Section 692A.106, Code 2021, is amended by adding
7the following new subsection:
8   NEW SUBSECTION.  8.  A sex offender who is required to
9register in another jurisdiction under the other jurisdiction’s
10sex offender registry but who resides, is employed, or attends
11school in this state shall be required to register for a period
12of time equal to the period of time required under the other
13jurisdiction’s requirements or under Iowa law, whichever is
14longer.
15   Sec. 3.  Section 692A.126, subsection 1, Code 2021, is
16amended by adding the following new paragraph:
17   NEW PARAGRAPH.  w.  Extortion in violation of section 711.4.
18   Sec. 4.  Section 711.4, Code 2021, is amended by adding the
19following new subsection:
20   NEW SUBSECTION.  4.  A person convicted of extortion under
21this section shall be required to register as a sex offender
22pursuant to the provisions of chapter 692A, if a determination
23is made that the offense was sexually motivated pursuant to
24section 692A.126.
25EXPLANATION
26The inclusion of this explanation does not constitute agreement with
27the explanation’s substance by the members of the general assembly.
   28This bill relates to the sex offender registry including
29duration of registration requirements and sexually motivated
30extortion.
   31The bill provides that a sex offender who is required to
32register in another jurisdiction under the other jurisdiction’s
33sex offender registry but who resides, is employed, or attends
34school in Iowa shall be required to register for a period of
35time equal to the period of time required under the other
-1-1jurisdiction’s requirements or under Iowa law, whichever is
2longer.
   3The bill provides that a person convicted of extortion shall
4be required to register as a sex offender pursuant to the
5provisions of Code chapter 692A if a determination is made that
6the offense was sexually motivated pursuant to Code section
7692A.126. If such a determination is made, the offender is
8classified as a tier III offender and the offender is required
9to register for a period of 10 years pursuant to Code section
10692A.106.
