5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  724.4D  Possession or carrying of
2dangerous weapon on certain property.
   31.  A person carrying or possessing a dangerous weapon,
4whether concealed or not, shall not enter upon or be present
5in the real property of an owner, lessee, or person in lawful
6possession of the real property without the express permission
7of the owner, lessee, or person in lawful possession of the
8real property if a printed or written notice forbidding such
9entry has been conspicuously posted or exhibited at the main
10entrance to the real property or the forbidden part of the
11property.
   122.  This section does not apply to the following:
   13a.  A person listed under section 724.4, subsection 4,
14paragraphs “a” through “d” or “j”.
   15b.  A person who has been specifically authorized by the
16owner, lessee, or person in lawful possession of the real
17property to carry or possess a dangerous weapon on the real
18property.
   193.  A person who violates this section commits a simple
20misdemeanor.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill relates to carrying or possessing a dangerous
25weapon when entering real property if a written notice
26forbidding such entry has been conspicuously posted.
   27Under the bill, a person carrying or possessing a dangerous
28weapon, whether concealed or not, shall not enter upon or be
29present in the real property of the owner, lessee, or person
30in lawful possession of the real property without the express
31permission of the owner, lessee, or person in lawful possession
32of the real property if a printed or written notice forbidding
33such entry has been conspicuously posted or exhibited at the
34main entrance to the property or the forbidden part of the
35property.

   1The following persons do not violate the bill: a person who
2goes armed with a dangerous weapon in the person’s own dwelling
3or place of business, or on land owned, possessed, or rented by
4the person; a person who has been specifically authorized by
5the owner, lessee, or person in lawful possession of the real
6property to carry or possess a dangerous weapon on the real
7property; a peace officer, when the officer’s duties require
8the person to carry a dangerous weapon; a member of the armed
9forces when the weapons are carried in connection with the
10person’s duties; a correctional officer, when the officer’s
11duties require; or a law enforcement officer from another state
12when the officer’s duties require the officer to carry the
13weapon and the officer is in this state for official duties.
   14A “dangerous weapon” is defined in Code section 702.7.
   15A person who violates the bill commits a simple misdemeanor
16punishable by confinement for no more than 30 days or a fine of
17at least $105 but not more than $855 or by both.
