5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  SPECIAL PROSECUTOR INTERIM STUDY COMMITTEE.  The
2legislative council shall establish an interim study
3committee composed of members of the senate and the house of
4representatives to meet during the 2021 legislative interim.
5The committee, in consultation with the justice department,
6Iowa county attorneys association, office of the state public
7defender, the Iowa state sheriffs’ and deputies’ association,
8the Iowa peace officers association, and other stakeholders,
9shall study issues relating to the appointment of a special
10prosecutor to investigate and prosecute incidents involving the
11use of deadly force by a peace officer. The committee shall
12submit its findings and recommendations to the general assembly
13by January 15, 2022, for consideration by the general assembly
14during the 2022 legislative session.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill establishes an interim study committee to review
19and develop recommendations for the appointment of a special
20prosecutor for incidents involving the use of deadly force by a
21peace officer.
   22The bill provides that the legislative council shall
23establish an interim study committee composed of members of
24the senate and the house of representatives to meet during the
252021 legislative interim. The committee, in consultation with
26the justice department, Iowa county attorneys association,
27state public defender, Iowa state sheriffs’ and deputies’
28association, Iowa peace officers association, and other
29stakeholders, shall study issues relating to the appointment
30of a special prosecutor to investigate and prosecute incidents
31involving the use of deadly force by a peace officer. The
32bill requires the committee to submit its findings and
33recommendations to the general assembly by January 15, 2022,
34for consideration by the general assembly during the 2022
35legislative session.
