3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 714.27, subsection 2, Code 2021, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  c.  A scrap metal dealer shall not make a
4purchase of a catalytic converter detached from a motor vehicle
5from a person unless the person presents a certification
6from the automobile repair shop which removed the catalytic
7converter.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
   11This bill relates to scrap metal transactions involving
12catalytic converters.
   13The bill provides that a scrap metal dealer shall not make a
14purchase of a catalytic converter detached from a motor vehicle
15from a person unless the person presents a certification
16from the automobile repair shop which removed the catalytic
17converter.
   18Unless otherwise exempt pursuant to Code section 714.27(5),
19a person who violates the bill is subject to a civil penalty in
20the amount of $100. A second violation within two years shall
21subject the person to a civil penalty in the amount of $500. A
22third or subsequent violation within two years shall subject
23the person to a civil penalty in the amount of $1,000.
