6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2REBUILD IOWA INFRASTRUCTURE FUND
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the following fiscal years, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   91.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
   10a.  (1)  For deposit in the water quality initiative fund
11created in section 466B.45 for purposes of supporting the
12water quality initiative administered by the division of soil
13conservation and water quality as provided in section 466B.42,
14including salaries, support, maintenance, and miscellaneous
15purposes, notwithstanding section 8.57, subsection 5, paragraph
16“c”:
   17FY 2020-2021:

   19(2)  (a)  The moneys appropriated in this lettered
20paragraph shall be used to support demonstration projects in
21subwatersheds as designated by the department that are part
22of high-priority watersheds identified by the water resources
23coordinating council.
   24(b)  The moneys appropriated in this lettered paragraph
25shall be used to support demonstration projects in watersheds
26generally, including regional watersheds, as designated by the
27division and high-priority watersheds identified by the water
28resources coordinating council.
   29(3)  In supporting projects in watersheds and subwatersheds
30as provided in subparagraph (2), subparagraph divisions (a) and
31(b), all of the following shall apply:
   32(a)  The demonstration projects shall utilize water quality
33practices as described in the latest revision of the document
34entitled “Iowa Nutrient Reduction Strategy” initially presented
35in November 2012 by the department of agriculture and land
-1-1stewardship, the department of natural resources, and Iowa
2state university of science and technology.
   3(b)  The division shall implement demonstration projects
4as provided in subparagraph division (a) by providing
5for participation by persons who hold a legal interest in
6agricultural land used in farming. To every extent practical,
7the division shall provide for collaborative participation by
8such persons who hold a legal interest in agricultural land
9located within the same subwatershed.
   10(c)  The division shall implement demonstration projects on
11a cost-share basis as determined by the division. Except for
12edge-of-field practices, the state’s share of the amount shall
13not exceed 50 percent of the estimated cost of establishing the
14practice as determined by the division or 50 percent of the
15actual cost of establishing the practice, whichever is less.
   16(d)  The demonstration projects shall be used to educate
17other persons about the feasibility and value of establishing
18similar water quality practices. The division shall promote
19field day events for purposes of allowing interested persons to
20establish water quality practices on their agricultural land.
   21(e)  The division shall conduct water quality evaluations
22within supported subwatersheds. Within a reasonable period
23after accumulating information from such evaluations, the
24division shall create an aggregated database of water quality
25practices. Any information identifying a person holding a
26legal interest in agricultural land or specific agricultural
27land shall be a confidential record.
   28(4)  The moneys appropriated in this lettered paragraph
29shall be used to support education and outreach in a manner
30that encourages persons who hold a legal interest in
31agricultural land used for farming to implement water quality
32practices, including the establishment of such practices in
33watersheds generally, and not limited to subwatersheds or
34high-priority watersheds.
   35(5)  The moneys appropriated in this lettered paragraph
-2-1may be used to contract with persons to coordinate the
2implementation of efforts provided in this paragraph.
   3(6)  The moneys appropriated in this lettered paragraph
4may be used by the department to support urban soil and water
5conservation efforts, which may include but are not limited
6to management practices related to bioretention, landscaping,
7the use of permeable or pervious pavement, and soil quality
8restoration. The moneys shall be allocated on a cost-share
9basis as provided in chapter 161A.
   10(7)  Notwithstanding any other provision of law to the
11contrary, the department may use moneys appropriated in
12this lettered paragraph to carry out the provisions of this
13paragraph on a cost-share basis in combination with other
14moneys available to the department from a state or federal
15source.
   16(8)  Not more than 10 percent of the moneys appropriated in
17this lettered paragraph may be used for costs of administration
18and implementation of the water quality initiative administered
19by the soil conservation division.
   20b.  For deposit in the renewable fuels infrastructure fund
21created in section 159A.16 for renewable fuel infrastructure
22programs:

22DIVISION IV
23MISCELLANEOUS PROVISIONS
24   Sec. 10.  Section 8.57C, subsection 3, paragraph a,
25subparagraph (2), Code 2020, is amended to read as follows:
   26(2)  The fiscal year beginning July 1, 2020 2021, and for
27each subsequent fiscal year thereafter.
28   Sec. 11.  Section 8.57C, subsection 3, Code 2020, is amended
29by adding the following new paragraph:
30   NEW PARAGRAPH.  i.  There is appropriated from the rebuild
31Iowa infrastructure fund for the fiscal year beginning
32July 1, 2020, and ending June 30, 2021, the sum of eighteen
33million five hundred fifty thousand dollars to the technology
34reinvestment fund, notwithstanding section 8.57, subsection 5,
35paragraph “c”.

1   Sec. 12.  STATE CAPITOL MAINTENANCE FUND.  Notwithstanding
2the standing appropriation in section 2.12B, there is
3appropriated from the rebuild Iowa infrastructure fund for
4deposit in the state capitol maintenance fund established in
5section 2.12B for the fiscal year beginning July 1, 2020, the
6sum of one hundred thousand dollars.
7   Sec. 13.  ROUTINE MAINTENANCE FUND.  Notwithstanding the
8standing appropriation in section 8A.330, there is appropriated
9from the rebuild Iowa infrastructure fund to the department of
10administrative services for deposit in the routine maintenance
11fund established in section 8A.330 for the fiscal year
12beginning July 1, 2020, the sum of one million dollars.
13DIVISION V
14CONTINGENT EFFECTIVE DATE AND RETROACTIVE APPLICABILITY
15   Sec. 14.  EFFECTIVE UPON ENACTMENT.  Unless otherwise
16provided, this Act, if approved by the governor on or after
17July 1, 2020, takes effect upon enactment.
18   Sec. 15.  RETROACTIVE APPLICABILITY.  Unless otherwise
19provided, this Act, if approved by the governor on or after
20July 1, 2020, applies retroactively to July 1, 2020.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill relates to and makes appropriations to state
25departments and agencies from the rebuild Iowa infrastructure
26fund and the technology reinvestment fund, and provides for
27related matters. The bill is organized by divisions.
   28DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
29division appropriates project funding for FY 2020-2021 from
30the rebuild Iowa infrastructure fund for projects for the
31departments of agriculture and land stewardship, cultural
32affairs, natural resources, public defense, public safety,
33transportation, and veterans affairs, and for the economic
34development authority, law enforcement academy, treasurer of
35state, and the judicial branch.

   1The division appropriates project funding for multiple
2fiscal years to the department of human services and the board
3of regents.
   4DIVISION II — TECHNOLOGY REINVESTMENT FUND. This
5division appropriates project funding for FY 2020-2021
6from the technology reinvestment fund for the departments
7of corrections, education, homeland security and emergency
8management, human rights, management, public health, revenue,
9and veterans affairs, and for the Iowa telecommunications and
10technology commission, ethics and campaign disclosure board,
11law enforcement academy, and the judicial branch.
   12DIVISION III — CHANGES TO PRIOR APPROPRIATIONS. The
13division makes a change to moneys appropriated from the rebuild
14Iowa infrastructure fund to the department of administrative
15services for major maintenance projects, the economic
16development authority for the vacant state buildings demolition
17and rehabilitation funds, and the board of regents for a
18project at the Iowa state university of science and technology.
19The division also makes a change to the reversion provision for
20moneys appropriated from the state bond repayment fund to the
21judicial branch for FY 2016-2017.
   22This division takes effect upon enactment.
   23DIVISION IV — MISCELLANEOUS PROVISIONS. Code section
248.57C, concerning the technology reinvestment fund, is amended
25to provide that the standing appropriation to the fund from the
26general fund for fiscal years beginning on or after July 1,
272020, is changed to fiscal years beginning on or after July 1,
282021, and to provide for an appropriation to the fund from the
29rebuild Iowa infrastructure fund for the fiscal year beginning
30July 1, 2020, of $18.55 million.
   31The bill reduces the standing appropriation from the rebuild
32Iowa infrastructure fund to the state capitol maintenance fund
33created in Code section 2.12B for the fiscal year beginning
34July 1, 2020, from $500,000 to $100,000.
   35The bill also reduces the standing appropriation from the
-15-1rebuild Iowa infrastructure fund to the routine maintenance
2fund created in Code section 8A.330 for the fiscal year
3beginning July 1, 2020, from $2 million to $1 million.
   4EFFECTIVE DATE AND RETROACTIVE APPLICABILITY. Unless
5otherwise provided, the bill, if approved by the governor on
6or after July 1, 2020, takes effect upon enactment and applies
7retroactively to July 1, 2020.
