2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  68A.507  Declaration of voluntary
2campaign expenditure limitation.
   31.  A candidate for the senate or house of representatives
4may submit to the general assembly a declaration that the
5candidate will not expend more than the following amounts
6during the course of the candidate’s campaign, including
7expenditures made during both primary and general elections:
   8a.  For a candidate for the senate, one hundred thousand
9dollars.
   10b.  For a candidate for the house of representatives, fifty
11thousand dollars.
   122.  A declaration described in subsection 1 shall be
13submitted to the general assembly no later than three days
14following the date upon which the candidate receives a
15nomination or makes a filing under chapter 43, 44, or 45 to
16have the candidate’s name placed on a ballot for election to
17the senate or house of representatives.
   183.  A candidate who has submitted a declaration described
19in subsection 1 shall submit all reports that the candidate or
20the candidate’s committee are required to submit to the board
21pursuant to section 68A.402 subsequent to the submission of the
22declaration to the president of the senate, for a candidate for
23the senate, or to the speaker of the house of representatives,
24for a candidate for the house of representatives.
   254.  a.  The president of the senate shall monitor campaign
26expenditures by candidates for the senate who have submitted
27a declaration described in subsection 1 and shall inform the
28senate if a candidate who has submitted such a declaration
29has made expenditures totaling more than one hundred thousand
30dollars.
   31b.  The speaker of the house of representatives shall
32monitor campaign expenditures by candidates for the house of
33representatives who have submitted a declaration described in
34subsection 1 and shall inform the house of representatives
35if a candidate who has submitted such a declaration has made
-1-1expenditures totaling more than fifty thousand dollars.
   25.  A violation of this section is not subject to a penalty
3pursuant to section 68A.701.
4EXPLANATION
5The inclusion of this explanation does not constitute agreement with
6the explanation’s substance by the members of the general assembly.
   7This bill relates to voluntary campaign expenditure
8limitations for candidates for the Iowa senate and house
9of representatives. The bill allows a candidate for the
10Iowa senate or house of representatives to submit to the
11general assembly a declaration that the candidate will make
12expenditures totaling less than $100,000 for the senate,
13or $50,000 for the house of representatives. A candidate
14who submits such a declaration shall submit reports that
15the candidate is required to submit to the Iowa ethics and
16campaign disclosure board, and the president of the senate,
17for a candidate for the senate, or the speaker of the
18house of representatives, for a candidate for the house of
19representatives shall monitor the total amount of expenditures.
20The president of the senate shall inform the senate if a
21candidate for the senate who has submitted a declaration has
22made campaign expenditures exceeding $100,000, and the speaker
23of the house of representatives shall inform the house of
24representatives if a candidate for the house of representatives
25who has submitted a declaration has made campaign expenditures
26exceeding $50,000.
   27A violation of the bill is not subject to a criminal penalty
28for a violation of Code chapter 68A.
