3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 29A.7, Code 2020, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 4. Notwithstanding any provision of law
4to the contrary, the governor shall not authorize the military
5forces of the state to serve on federal active duty in an area
6designated by the president of the United States or the United
7States Congress as a combat zone unless the United States
8Congress has passed an official declaration of war.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12This bill provides that the governor shall not authorize the
13military forces of the state to serve on federal active duty
14in a combat zone unless the United States Congress has passed
15an official declaration of war.
