3collective bargaining, providing related procedures, and
4including effective date and applicability provisions.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 20.9, subsection 1, Code 2020, is amended
2to read as follows:
   31.  For negotiations regarding a bargaining unit with
4at least thirty percent of members who are public safety
5employees, the public employer and the employee organization
6shall meet at reasonable times, including meetings reasonably
7in advance of the public employer’s budget-making process,
8to negotiate in good faith with respect to wages, hours,
9vacations, insurance, holidays, leaves of absence, shift
10differentials, overtime compensation, supplemental pay,
11seniority, transfer procedures, job classifications, health
12and safety matters, evaluation procedures, procedures for
13staff reduction, in-service training, grievance procedures
14for resolving any questions arising under the agreement,
15and other matters mutually agreed upon. For negotiations
16regarding a bargaining unit that does not have at least thirty
17percent of members who are public safety employees, the public
18employer and the employee organization shall meet at reasonable
19times, including meetings reasonably in advance of the public
20employer’s budget-making process, to negotiate in good faith
21with respect to base wages and other matters mutually agreed
22upon. Negotiations regarding all bargaining units shall also
23include terms authorizing dues checkoff for members of the
24employee organization. If an agreement provides for dues
25checkoff, a member’s dues may be checked off only upon the
26member’s written request and the member may terminate the dues
27checkoff at any time by giving thirty days’ written notice.

28 Such obligation to negotiate in good faith does not compel
29either party to agree to a proposal or make a concession.
30Mandatory subjects of negotiation specified in this subsection
31shall be interpreted narrowly and restrictively.
32   Sec. 2.  Section 70A.17A, Code 2020, is amended by adding the
33following new subsection:
34   NEW SUBSECTION.  3.  This section shall not affect a payroll
35deduction elected by a state employee pursuant to section
-1-170A.19.
2   Sec. 3.  Section 70A.19, Code 2020, is amended by striking
3the section and inserting in lieu thereof the following:
   470A.19  Duration of state payroll deduction for dues of
5employee organization member.
  6A state employee who elects a payroll deduction for
7membership dues to an employee organization pursuant to the
8provisions of a collective bargaining agreement negotiated
9under the provisions of chapter 20 shall maintain the deduction
10for a period of one year or until the expiration of the
11collective bargaining agreement, whichever occurs first. A
12state employee who transfers employment to a position covered
13by a different collective bargaining agreement or who becomes
14a management employee is not subject to this requirement.
15With respect to state employees, this section supersedes the
16provisions of section 20.9 allowing termination of a dues
17checkoff at any time but does not supersede the requirement for
18thirty days’ written notice of termination.
19   Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of immediate
20importance, takes effect upon enactment.
21   Sec. 5.  APPLICABILITY.  This Act applies to collective
22bargaining procedures pursuant to chapter 20 initiated on or
23after the effective date of this Act.
24EXPLANATION
25The inclusion of this explanation does not constitute agreement with
26the explanation’s substance by the members of the general assembly.
   27This bill provides that the scope of negotiations for
28collective bargaining between public employers and public
29employees shall include terms authorizing dues checkoff for
30employees who are members of employee organizations.
   31The bill strikes a prohibition on public employers
32authorizing or administering a deduction from the salaries
33or wages of its employees for membership dues to an employee
34organization. The bill provides procedures for administering
35such dues deductions.

   1The bill takes effect upon enactment and applies to
2collective bargaining procedures pursuant to Code chapter 20
3initiated on or after the effective date of the bill.
