Senate Study Bill 3024 - IntroducedA Bill ForAn Act 1relating to certain appeals by nonprofit organizations
2concerning reimbursement of the department of workforce
3development for the cost of unemployment benefits.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 96.7, subsection 8, paragraph b,
2subparagraph (4), Code 2020, is amended to read as follows:
   3(4)  The amount due specified in a bill from the department
4is conclusive unless, not later than fifteen days following
5the date the bill was mailed or otherwise delivered to
6the last known address of the nonprofit organization, the
7nonprofit organization files an application for redetermination
8with the department setting forth the grounds for the
9application. The department shall promptly review the amount
10due specified in the bill and shall issue a redetermination.
11The redetermination is conclusive on the nonprofit organization
12unless, not later than within thirty days after the
13redetermination was mailed or otherwise delivered to the
14last known address of the nonprofit organization,
 mailing of
15the notification,
the nonprofit organization files an appeal
16
 appeals to the district court pursuant department for a hearing
17 to subsection 5 determine the eligibility of the individual
18to receive benefits
The appeal shall be referred to an
19administrative law judge for hearing, and the employer and the
20individual shall receive notice of the time and place of the
21hearing.

22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25This bill provides that an appeal by a nonprofit
26organization of a redetermination by the department of
27workforce development of the amount due for reimbursement of
28the cost of unemployment benefits, for nonprofit organizations
29that have elected to pay such costs by reimbursement, shall be
30referred to an administrative law judge for hearing. Under
31current law, such appeals are filed in district court.
