CHAPTER 111Disaster emergency assistance by licensed architects and professional engineers — immunityS.F. 570AN ACT providing for immunity from civil liability for licensed architects and professional engineers providing disaster emergency assistance under specified circumstances and including effective date provisions.Be It Enacted by the General Assembly of the State of Iowa:   Section 1.   NEW SECTION.  29C.20C  Immunity licensed architects and professional engineers.   An architect licensed pursuant to chapter 544A or a professional engineer licensed pursuant to chapter 542B who, during a disaster emergency as proclaimed by the governor or a major disaster as declared by the president of the United States, in good faith and at the request of or with the approval of a national, state, or local public official, law enforcement official, public safety official, or building inspection official believed by the licensed architect or professional engineer to be acting in an official capacity, voluntarily and without compensation provides architectural, engineering, structural, electrical, mechanical, or other design professional services related to the disaster emergencySee chapter 89, §8 herein shall not be liable for civil damages for any acts or omissions resulting from the services provided, unless such acts or omissions constitute recklessness or willful and wanton misconduct. A licensed architect or professional engineer who receives expense reimbursement for the performance of services described in this section shall not be considered to have received compensation for such services.   Sec. 2.   EFFECTIVE DATE.  This Act, being deemed of immediate importance, takes effect upon enactment.Approved May 10, 2019
