7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2Fiscal year 2019-2020 Appropriations
3   Section 1.  DEPARTMENT OF CULTURAL AFFAIRS.
   41.  There is appropriated from the general fund of the state
5to the department of cultural affairs for the fiscal year
6beginning July 1, 2019, and ending June 30, 2020, the following
7amounts, or so much thereof as is necessary, to be used for the
8purposes designated:
   9a.  ADMINISTRATION
   10For salaries, support, maintenance, and miscellaneous
11purposes, and for not more than the following full-time
12equivalent positions for the department:

   15The department of cultural affairs shall coordinate
16activities with the tourism office of the economic development
17authority to promote attendance at the state historical
18building and at this state’s historic sites.
   19Full-time equivalent positions authorized under this

21appropriated under this paragraph and paragraphs “c” through
22“g”.
   23b.  COMMUNITY CULTURAL GRANTS

   162.  Notwithstanding section 8.33, moneys appropriated in

20close of the succeeding fiscal year.
21   Sec. 2.  GOALS AND ACCOUNTABILITY — ECONOMIC DEVELOPMENT.
   221.  For the fiscal year beginning July 1, 2019, the goals
23for the economic development authority shall be to expand and
24stimulate the state economy, increase the wealth of Iowans, and
25increase the population of the state.
   262.  To achieve the goals in subsection 1, the economic
27development authority shall do all of the following for the
28fiscal year beginning July 1, 2019:
   29a.  Concentrate its efforts on programs and activities that
30result in commercially viable products and services.
   31b.  Adopt practices and services consistent with free
32market, private sector philosophies.
   33c.  Ensure economic growth and development throughout the
34state.
   35d.  Work with businesses and communities to continually
-2-1improve the economic development climate along with the
2economic well-being and quality of life for Iowans.
   3e.  Coordinate with other state agencies to ensure that they
4are attentive to the needs of an entrepreneurial culture.
   5f.  Establish a strong and aggressive marketing image to
6showcase Iowa’s workforce, existing industry, and potential.
7A priority shall be placed on recruiting new businesses,
8business expansion, and retaining existing Iowa businesses.
9Emphasis shall be placed on entrepreneurial development through
10helping entrepreneurs secure capital, and developing networks
11and a business climate conducive to entrepreneurs and small
12businesses.
   13g.  Encourage the development of communities and quality of
14life to foster economic growth.
   15h.  Prepare communities for future growth and development
16through development, expansion, and modernization of
17infrastructure.
   18i.  Develop public-private partnerships with Iowa businesses
19in the tourism industry, Iowa tour groups, Iowa tourism
20organizations, and political subdivisions in this state to
21assist in the development of advertising efforts.
   22j.  Develop, to the fullest extent possible, cooperative
23efforts for advertising with contributions from other sources.
24   Sec. 3.  ECONOMIC DEVELOPMENT AUTHORITY.
   251.  APPROPRIATION
   26a.  There is appropriated from the general fund of the state
27to the economic development authority for the fiscal year
28beginning July 1, 2019, and ending June 30, 2020, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated in this subsection, and for not more than
31the following full-time equivalent positions:

   34b.  (1)  For salaries, support, miscellaneous purposes,
35programs, marketing, and the maintenance of an administration
-3-1division, a business development division, a community
2development division, a small business development division,
3and other divisions the authority may organize.
   4(2)  The full-time equivalent positions authorized under
5this section are funded, in whole or in part, by the moneys
6appropriated under this subsection or by other moneys received
7by the authority, including certain federal moneys.
   8(3)  For business development operations and programs,
9international trade, export assistance, workforce recruitment,
10and the partner state program.
   11(4)  For transfer to a fund created pursuant to section
1215.313 for purposes of financing strategic infrastructure
13projects.
   14(5)  For community economic development programs, tourism
15operations, community assistance, plans for Iowa green corps
16and summer youth programs, the mainstreet and rural mainstreet
17programs, the school-to-career program, the community
18development block grant, and housing and shelter-related
19programs.
   20(6)  For achieving the goals and accountability, and
21fulfilling the requirements and duties required under this Act.
   22c.  Notwithstanding section 8.33, moneys appropriated in
23this subsection that remain unencumbered or unobligated at the
24close of the fiscal year shall not revert but shall remain
25available for expenditure for the purposes designated in this
26subsection until the close of the succeeding fiscal year.
   272.  FINANCIAL ASSISTANCE RESTRICTIONS
   28a.  A business creating jobs through moneys appropriated in
29subsection 1 shall be subject to contract provisions requiring
30new and retained jobs to be filled by individuals who are
31citizens of the United States who reside within the United
32States or any person authorized to work in the United States
33pursuant to federal law, including legal resident aliens in the
34United States.
   35b.  Any vendor who receives moneys appropriated in
-4-1subsection 1 shall adhere to such contract provisions and
2provide periodic assurances as the state shall require that the
3jobs are filled solely by citizens of the United States who
4reside within the United States or any person authorized to
5work in the United States pursuant to federal law, including
6legal resident aliens in the United States.
   7c.  A business that receives financial assistance from
8the authority from moneys appropriated in subsection 1 shall
9only employ individuals legally authorized to work in this
10state. In addition to all other applicable penalties provided
11by current law, all or a portion of the assistance received
12by a business which is found to knowingly employ individuals
13not legally authorized to work in this state is subject to
14recapture by the authority.
   153.  USES OF APPROPRIATIONS
   16a.  From the moneys appropriated in subsection 1, the
17authority may provide financial assistance in the form of a
18grant to a community economic development entity for conducting
19a local workforce recruitment effort designed to recruit former
20citizens of the state and former students at colleges and
21universities in the state to meet the needs of local employers.
   22b.  From the moneys appropriated in subsection 1, the
23authority may provide financial assistance to early stage
24industry companies being established by women entrepreneurs.
   25c.  From the moneys appropriated in subsection 1, the
26authority may provide financial assistance in the form of
27grants, loans, or forgivable loans for advanced research and
28commercialization projects involving value-added agriculture,
29advanced technology, or biotechnology.
   30d.  The authority shall not use any moneys appropriated in
31subsection 1 for purposes of providing financial assistance for
32the Iowa green streets pilot project or for any other program
33or project that involves the installation of geothermal systems
34for melting snow and ice from streets or sidewalks.
   354.WORLD FOOD PRIZE

1There is appropriated from the general fund of the state
2to the economic development authority for the fiscal year
3beginning July 1, 2019, and ending June 30, 2020, the following
4amount for the world food prize and in lieu of the standing
5appropriation in section 15.368:

   75.IOWA COMMISSION ON VOLUNTEER SERVICE
8There is appropriated from the general fund of the state
9to the economic development authority for the fiscal year
10beginning July 1, 2019, and ending June 30, 2020, the following
11amount for allocation to the Iowa commission on volunteer
12service for purposes of the Iowa state commission grant
13program, the Iowa’s promise and Iowa mentoring partnership
14programs, and for not more than the following full-time
15equivalent positions:

18Of the moneys appropriated in this subsection, the
19authority shall allocate $75,000 for purposes of the Iowa state
20commission grant program and $93,201 for purposes of the Iowa’s

23subsection that remain unencumbered or unobligated at the close
24of the fiscal year shall not revert but shall remain available
25for expenditure for the purposes designated until the close of

   276.  COUNCILS OF GOVERNMENTS — ASSISTANCE
   28There is appropriated from the general fund of the state
29to the economic development authority for the fiscal year
30beginning July 1, 2019, and ending June 30, 2020, the following
31amount to be used for the purposes of providing financial
32assistance to Iowa’s councils of governments:

   347.  REGISTERED APPRENTICESHIP PROGRAM
   35There is appropriated from the general fund of the

2year beginning July 1, 2019, and ending June 30, 2020, the
3following amount to be used for the funding of a registered
4apprenticeship development program designed to encourage
5small to midsize businesses to start or grow registered
6apprenticeships:

   88.  SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
9INTERNSHIPS
   10a.  There is appropriated from the Iowa skilled worker and
11job creation fund created in section 8.75 to the Iowa economic
12development authority for the fiscal year beginning July 1,
132019, and ending June 30, 2020, the following amount, or so
14much thereof as is necessary, for the purposes designated:
   15For the funding of internships for students studying in the
16fields of science, technology, engineering, and mathematics
17with eligible Iowa employers as provided in section 15.411,
18subsection 3, paragraph “c”:

   20b.  No more than 3 percent of the moneys appropriated in this
21subsection may be used by the authority for costs associated
22with administration of the internship program.
   23c.  Notwithstanding section 8.33, moneys appropriated in

26available for expenditure for the purposes designated in
27subsequent fiscal years.
   289.  FUTURE READY IOWA — VOLUNTEER MENTORING PROGRAM
   29a.  There is appropriated from the Iowa skilled worker and
30job creation fund created in section 8.75 to the economic
31development authority for the fiscal year beginning July 1,
322019, and ending June 30, 2020, the following amount, or so
33much thereof as is necessary, for the purpose designated:
   34For allocation to the Iowa commission on volunteer services
35to be used for establishing a volunteer mentor program to
-7-1support implementation of the future ready Iowa skilled
2workforce last-dollar scholarship program in section 261.131
3and the future ready Iowa skilled workforce grant program
4created in section 261.132:

   1110.  EMPOWER RURAL IOWA — HOUSING NEEDS ASSESSMENT GRANT
12PROGRAM
   13a.  There is appropriated from the Iowa skilled worker and
14job creation fund created in section 8.75 to the economic
15development authority for the fiscal year beginning July 1,
162019, and ending June 30, 2020, the following amount, or so
17much thereof as is necessary, for the purpose designated:
   18To be distributed by the authority for establishing a
19housing needs assessment grant program to provide small
20communities with hard data and housing-related information
21specific to the community being analyzed:

   23b.  Notwithstanding section 8.33, moneys appropriated in
24this subsection which remain unencumbered or unobligated at
25the end of the fiscal year shall not revert but shall remain
26available for expenditure for the purposes designated until the

   28c.  The authority shall adopt rules pursuant to chapter
2917A to establish criteria for the distribution of the moneys
30appropriated in this subsection.
   3111.  EMPOWER RURAL IOWA — RURAL INNOVATION GRANTS
   32a.  There is appropriated from the Iowa skilled worker and
33job creation fund created in section 8.75 to the economic
34development authority for the fiscal year beginning July 1,
352019, and ending June 30, 2020, the following amount, or so
-8-1much thereof as is necessary, for the purpose designated:
   2To be distributed by the authority for supporting innovative
3rural projects:

   5b.  Notwithstanding section 8.33, moneys appropriated in
6this subsection which remain unencumbered or unobligated at
7the end of the fiscal year shall not revert but shall remain
8available for expenditure for the purposes designated until the
9close of the succeeding fiscal year.
   10c.  The authority shall adopt rules pursuant to chapter
1117A to establish criteria for the distribution of the moneys
12appropriated in this subsection.
13   Sec. 4.  LIMITATIONS OF STANDING APPROPRIATIONS — FY
142019-2020.
  Notwithstanding the standing appropriations
15in the following designated sections for the fiscal year
16beginning July 1, 2019, and ending June 30, 2020, the amounts
17appropriated from the general fund of the state pursuant to
18these sections for the following purposes shall not exceed the
19following amounts:
   201.  For operational support grants and community cultural
21grants under section 99F.11, subsection 3, paragraph “d”,
22subparagraph (1):

   242.  For the purposes of regional tourism marketing under
25section 99F.11, subsection 3, paragraph “d”, subparagraph (2):

27   Sec. 5.  FINANCIAL ASSISTANCE REPORTING — ECONOMIC
28DEVELOPMENT AUTHORITY.
  The economic development authority and
29the department of revenue shall submit a joint annual report
30to the general assembly no later than November 1, 2019, that
31details the amount of every direct loan, forgivable loan,
32tax credit, tax exemption, tax refund, grant, or any other
33financial assistance awarded to a person during the prior
34fiscal year by the authority under an economic development
35program administered by the authority. The report shall
-9-1identify the county where the project associated with each such
2award is located.
3   Sec. 6.  INSURANCE ECONOMIC DEVELOPMENT.  From the
4moneys collected by the insurance division in excess of the
5anticipated gross revenues under section 505.7, subsection
63, during the fiscal year beginning July 1, 2019, $100,000
7shall be transferred to the economic development authority for
8insurance economic development and international insurance
9economic development.
10   Sec. 7.  IOWA FINANCE AUTHORITY.
   111.  There is appropriated from the general fund of the state
12to the Iowa finance authority for the fiscal year beginning
13July 1, 2019, and ending June 30, 2020, the following amount,
14or so much thereof as is necessary, to be used to provide
15reimbursement for rent expenses to eligible persons under
16the home and community-based services rent subsidy program
17established in section 16.55:

   192.  Of the moneys appropriated in this section, not more than
20$35,000 may be used for administrative costs.
   213.  Notwithstanding section 8.33, moneys appropriated in
22this section that remain unencumbered or unobligated at the
23close of the fiscal year shall not revert but shall remain
24available for expenditure for the purposes designated until the
25close of the succeeding fiscal year.
26   Sec. 8.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of state
27is requested to review the audit of the Iowa finance authority
28performed by the auditor hired by the authority.
29   Sec. 9.  PUBLIC EMPLOYMENT RELATIONS BOARD.
   301.  There is appropriated from the general fund of the state
31to the public employment relations board for the fiscal year
32beginning July 1, 2019, and ending June 30, 2020, the following
33amount, or so much thereof as is necessary, for the purposes
34designated:
   35For salaries, support, maintenance, and miscellaneous

   52.  Of the moneys appropriated in this section, the board
6shall allocate $15,000 for maintaining an internet site that
7allows searchable access to a database of collective bargaining

9   Sec. 10.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There
10is appropriated from the general fund of the state to the
11department of workforce development for the fiscal year
12beginning July 1, 2019, and ending June 30, 2020, the following
13amounts, or so much thereof as is necessary, for the purposes
14designated:
   151.  DIVISION OF LABOR SERVICES
   16a.  For the division of labor services, including salaries,
17support, maintenance, and miscellaneous purposes, and for not
18more than the following full-time equivalent positions:

   21b.  From the contractor registration fees, the division of
22labor services shall reimburse the department of inspections
23and appeals for all costs associated with hearings under
24chapter 91C, relating to contractor registration.
   252.  DIVISION OF WORKERS’ COMPENSATION
   26a.  For the division of workers’ compensation, including
27salaries, support, maintenance, and miscellaneous purposes, and
28for not more than the following full-time equivalent positions:

   31b.  The division of workers’ compensation shall charge a
32$100 filing fee for workers’ compensation cases. The filing
33fee shall be paid by the petitioner of a claim. However, the
34fee can be taxed as a cost and paid by the losing party, except
35in cases where it would impose an undue hardship or be unjust
-11-1under the circumstances. The moneys generated by the filing
2fee allowed under this subsection are appropriated to the
3department of workforce development to be used for purposes of
4administering the division of workers’ compensation.
   53.  WORKFORCE DEVELOPMENT OPERATIONS
   6a.  For the operation of field offices, the workforce
7development board, and for not more than the following
8full-time equivalent positions:

   17a.  For the development and administration of an offender
18reentry program to provide offenders with employment skills,
19and for not more than the following full-time equivalent

20following amount, or so much thereof as is necessary, to be
21used for the purposes designated:
   22For enhancing efforts to investigate employers that
23misclassify workers and for not more than the following
24full-time equivalent positions:

32as is necessary, to be used for field offices:

4   Sec. 13.  FUTURE READY IOWA — IOWA EMPLOYER INNOVATION FUND.
   51.  There is appropriated from the general fund of the state
6to the department of workforce development for the fiscal year
7beginning July 1, 2019, and ending June 30, 2020, the following
8amount, or so much thereof as is necessary, to be used for the
9purposes designated:
   10In consultation with the workforce development board, for
11funding of the Iowa employer innovation program which shall
12match eligible employer moneys to expand opportunities for
13education and training leading to high-demand jobs and to
14encourage Iowa employers, community leaders, and others to
15provide leadership and support for regional workforce talent
16pools throughout the state, and for future ready Iowa education
17and outreach:

   192.  Notwithstanding section 8.33, moneys appropriated in
20this section which remain unencumbered or unobligated at the
21end of the fiscal year shall not revert but shall remain

24   Sec. 14.  HOME BASE IOWA.
   251.  There is appropriated from the general fund of the state
26to the department of workforce development for the fiscal year
27beginning July 1, 2019, and ending June 30, 2020, the following
28amount, or so much thereof as is necessary, to be used for the
29purposes designated:
   30To fund a position to assist with support of home base Iowa

4   Sec. 15.  UNEMPLOYMENT COMPENSATION RESERVE FUND —
5FIELD OFFICES.
  Notwithstanding section 96.9, subsection 8,
6paragraph “e”, there is appropriated from interest earned on
7the unemployment compensation reserve fund to the department
8of workforce development for the fiscal year beginning July 1,
92019, and ending June 30, 2020, the following amount, or so
10much thereof as is necessary, for the purposes designated:
   11For the operation of field offices:

13   Sec. 16.  VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES.  The
14department of workforce development shall require a unique
15identification login for all users of workforce development
16centers operated through electronic means.
17   Sec. 17.  UNEMPLOYMENT COMPENSATION PROGRAM.  Notwithstanding
18section 96.9, subsection 4, paragraph “a”, moneys credited to
19the state by the secretary of the treasury of the United
20States pursuant to section 903 of the Social Security
21Act are appropriated to the department of workforce
22development and shall be used by the department for the
23administration of the unemployment compensation program only.
24This appropriation shall not apply to any fiscal year
25beginning after December 31, 2019.
26   Sec. 18.   IOWA SKILLED WORKER AND JOB CREATION FUND.
   271.  There is appropriated from the Iowa skilled worker and
28job creation fund created in section 8.75 to the following
29departments, agencies, and institutions for the fiscal year
30beginning July 1, 2019, and ending June 30, 2020, the following
31amounts, or so much thereof as is necessary, to be used for the
32purposes designated:
   33a.  ECONOMIC DEVELOPMENT AUTHORITY
   34(1)  For the purposes of providing assistance under the high
35quality jobs program as described in section 15.335B:

   2(2)  From the moneys appropriated in this lettered paragraph
3“a”, the economic development authority may use not more than
4$1,000,000 for purposes of providing infrastructure grants to
5mainstreet communities under the main street Iowa program.
   6(3)  As a condition of receiving moneys appropriated in
7this lettered paragraph “a”, an entity shall testify upon the
8request of the joint appropriations subcommittee on economic
9development regarding the expenditure of such moneys.
   10b.  STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
   11(1)  STATE BOARD OF REGENTS. For capacity building
12infrastructure in areas related to technology
13commercialization, marketing and business development
14efforts in areas related to technology commercialization,
15entrepreneurship, and business growth, and infrastructure

17activities under chapter 262B:

   19(a)  Of the moneys appropriated pursuant to this
20subparagraph (1), 35 percent shall be allocated for Iowa state
21university of science and technology, 35 percent shall be
22allocated for the state university of Iowa, and 30 percent
23shall be allocated for the university of northern Iowa.
   24(b)  The institutions shall provide a one-to-one match
25of additional moneys for the activities funded with moneys
26appropriated under this subparagraph (1).
   27(c)  The state board of regents shall submit a report by
28January 15, 2020, to the governor, the general assembly, and
29the legislative services agency regarding the activities,
30projects, and programs funded with moneys appropriated under
31this subparagraph (1). The report shall be provided in an
32electronic format and shall include a list of metrics and
33criteria mutually agreed to in advance by the board of regents
34and the economic development authority. The metrics and
35criteria shall allow the governor’s office and the general
-16-1assembly to quantify and evaluate the progress of the board of
2regents institutions with regard to their activities, projects,
3and programs in the areas of technology commercialization,
4entrepreneurship, regional development, and market research.
   5(2)  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
6small business development centers, the science and technology
7research park, and the center for industrial research and
8service, and for not more than the following full-time
9equivalent positions:

   12(a)  Of the moneys appropriated in this subparagraph (2),
13Iowa state university of science and technology shall allocate
14at least $735,728 for purposes of funding small business
15development centers. Iowa state university of science and
16technology may allocate the appropriated moneys to the various
17small business development centers in any manner necessary to
18achieve the purposes of this subparagraph.
   19(b)  Iowa state university of science and technology shall
20do all of the following:
   21(i)  Direct expenditures for research toward projects that
22will provide economic stimulus for Iowa.
   23(ii)  Provide emphasis to providing services to Iowa-based
24companies.
   25(c)  It is the intent of the general assembly that the
26industrial incentive program focus on Iowa industrial sectors
27and seek contributions and in-kind donations from businesses,
28industrial foundations, and trade associations, and that moneys
29for the center for industrial research and service industrial
30incentive program shall be allocated only for projects which
31are matched by private sector moneys for directed contract
32research or for nondirected research. The match required of
33small businesses as defined in section 15.102, subsection 8,
34for directed contract research or for nondirected research
35shall be $1 for each $3 of state funds. The match required
-17-1for other businesses for directed contract research or
2for nondirected research shall be $1 for each $1 of state
3funds. The match required of industrial foundations or trade
4associations shall be $1 for each $1 of state funds.
   5Iowa state university of science and technology shall
6report annually to the joint appropriations subcommittee on
7economic development and the legislative services agency the
8total amount of private contributions, the proportion of
9contributions from small businesses and other businesses, and
10the proportion for directed contract research and nondirected
11research of benefit to Iowa businesses and industrial sectors.
   12(3)  STATE UNIVERSITY OF IOWA. For the state university
13of Iowa research park and for the advanced drug development
14program at the Oakdale research park, including salaries,
15support, maintenance, equipment, and miscellaneous purposes,
16and for not more than the following full-time equivalent
17positions:

   3(a)  Of the moneys appropriated pursuant to this

   8(b)  The university of northern Iowa shall do all of the
9following:
   10(i)  Direct expenditures for research toward projects that
11will provide economic stimulus for Iowa.
   12(ii)  Provide emphasis to providing services to Iowa-based
13companies.
   14(6)  As a condition of receiving moneys appropriated in
15this lettered paragraph “b”, an entity shall testify upon the
16request of the joint appropriations subcommittee on economic
17development regarding the expenditure of such moneys.
   18c.  DEPARTMENT OF WORKFORCE DEVELOPMENT
   19To develop a long-term sustained program to train unemployed
20and underemployed central Iowans with skills necessary to
21advance to higher-paying jobs with full benefits:

   23(1)  The department of workforce development shall begin
24a request for proposals process, issued for purposes of this
25lettered paragraph “c”, no later than September 1, 2019.
   26(2)  As a condition of receiving moneys appropriated under
27this lettered paragraph “c”, an entity shall testify upon the
28request of the joint appropriations subcommittee on economic
29development regarding the expenditure of such moneys.
   30d.  COLLEGE STUDENT AID COMMISSION
   31For deposit in the future ready Iowa skilled workforce grant
32fund established pursuant to section 261.132, as enacted by
332018 Iowa Acts, chapter 1067, section 13:

   352.  Notwithstanding section 8.33, moneys appropriated in

2close of the fiscal year shall not revert but shall remain
3available for expenditure for the purposes designated until the
4close of the succeeding fiscal year.
5   Sec. 19.  GENERAL FUND — CERTAIN REGENTS INSTITUTIONS.
   61.  There is appropriated from the general fund of the state
7to the following institutions for the fiscal year beginning
8July 1, 2019, and ending June 30, 2020, the following amounts,
9or so much thereof as is necessary, to be used for the purposes
10designated:

16salaries, support, maintenance, and miscellaneous purposes, and
17for not more than the following full-time equivalent positions:

   3The university of northern Iowa shall make a good faith
4effort to coordinate with private entities to seek funds to

   72.  Notwithstanding section 8.33, moneys appropriated in
8subsection 1, paragraphs “a” and “b”, that remain unencumbered
9or unobligated at the close of the fiscal year shall not revert
10but shall remain available for expenditure for the purposes
11designated until the close of the succeeding fiscal year.
12DIVISION II
13Miscellaneous Provisions
14   Sec. 20.  Section 16.2, Code 2019, is amended by adding the
15following new subsection:
16   NEW SUBSECTION.  2A.  There shall be four ex officio,
17nonvoting legislative members consisting of the following:
   18a.  Two state senators, one appointed by the majority leader
19of the senate and one appointed by the minority leader of the
20senate from their respective parties.
   21b.  Two state representatives, one appointed by the speaker
22and one appointed by the minority leader of the house of
23representatives from their respective parties.
24   Sec. 21.  Section 16.2, subsection 3, Code 2019, is amended
25to read as follows:
   263.  Five voting members of the authority constitute a quorum
27and the affirmative vote of a majority of the appointed members
28is necessary for any substantive action taken by the authority.
29The majority shall not include any member who has a conflict of
30interest and a statement by a member of a conflict of interest
31shall be conclusive for this purpose. A vacancy in the
32membership does not impair the right of a quorum to exercise
33all rights and perform all duties of the authority.
