2DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
3GENERAL APPROPRIATION
4   Section 1.  GENERAL FUND — DEPARTMENT.
   51.  There is appropriated from the general fund of the state
6to the department of agriculture and land stewardship for the
7fiscal year beginning July 1, 2019, and ending June 30, 2020,
8the following amount, or so much thereof as is necessary, to be
9used for the purposes designated:
   10For purposes of supporting the department, including its
11divisions, for administration, regulation, and programs; for
12salaries, support, maintenance, and miscellaneous purposes; and
13for not more than the following full-time equivalent positions:

   162.  Of the amount appropriated in subsection 1, the following

   304.  The department shall submit a report each quarter of the
31fiscal year to the legislative services agency, the department

33subcommittee on agriculture and natural resources, and the
34chairpersons and ranking members of the senate and house
35committees on appropriations. The report shall describe in
-1-1detail the expenditure of moneys appropriated in this section
2to support the department’s administration, regulation, and
3programs.
4DESIGNATED APPROPRIATIONs
5MISCELLANEOUS FUNDS
6   Sec. 2.  UNCLAIMED PARI-MUTUEL WAGERING WINNINGS —
7HORSE AND DOG RACING.
  There is appropriated from the moneys
8available under section 99D.13 to the department of agriculture
9and land stewardship for the fiscal year beginning July 1,
102019, and ending June 30, 2020, the following amount, or so
11much thereof as is necessary, to be used for the purposes
12designated:
   13For purposes of supporting the department’s administration
14and enforcement of horse and dog racing law pursuant to section
1599D.22, including for salaries, support, maintenance, and
16miscellaneous purposes:

30   Sec. 4.  DAIRY REGULATION.

34the following amount, or so much thereof as is necessary, to be
35used for the purposes designated:

   52.  Notwithstanding section 8.33, moneys appropriated in

10   Sec. 5.  LOCAL FOOD AND FARM PROGRAM.
   111.  There is appropriated from the general fund of the state
12to the department of agriculture and land stewardship for the
13fiscal year beginning July 1, 2019, and ending June 30, 2020,
14the following amount, or so much thereof as is necessary, to be
15used for the purposes designated:
   16For purposes of supporting the local food and farm program
17pursuant to chapter 267A:

   192.  The department shall enter into a cost-sharing agreement
20with Iowa state university of science and technology to support
21the local food and farm program coordinator position as part of
22the university’s cooperative extension service in agriculture
23and home economics pursuant to chapter 267A.
   243.  Notwithstanding section 8.33, moneys appropriated in
25this section that remain unencumbered or unobligated at the
26close of the fiscal year shall not revert but shall remain
27available to be used for the purposes designated until the
28close of the succeeding fiscal year.
29   Sec. 6.  AGRICULTURAL EDUCATION.
   301.  There is appropriated from the general fund of the state
31to the department of agriculture and land stewardship for the
32fiscal year beginning July 1, 2019, and ending June 30, 2020,
33the following amount, or so much thereof as is necessary, to be
34used for the purposes designated:
   35For purposes of allocating moneys to an Iowa association
-3-1affiliated with a national organization which promotes
2agricultural education providing for future farmers:

   42.  Notwithstanding section 8.33, moneys appropriated in
5this section that remain unencumbered or unobligated at the
6close of the fiscal year shall not revert but shall remain
7available to be used for the purposes designated until the
8close of the succeeding fiscal year.
9   Sec. 7.  FARMERS WITH DISABILITIES PROGRAM.
   101.  There is appropriated from the general fund of the state
11to the department of agriculture and land stewardship for the
12fiscal year beginning July 1, 2019, and ending June 30, 2020,
13the following amount, or so much thereof as is necessary, to be
14used for the purposes designated:
   15For purposes of supporting a program for farmers with
16disabilities:

   182.  The moneys appropriated in subsection 1 shall be used for
19the public purpose of providing a grant to a national nonprofit
20organization with over 80 years of experience in assisting
21children and adults with disabilities and special needs. The
22moneys shall be used to support a nationally recognized program
23that began in 1986 and has been replicated in at least 30 other
24states, but which is not available through any other entity
25in this state, and that provides assistance to farmers with
26disabilities in all 99 counties to allow the farmers to remain
27in their own homes and be gainfully engaged in farming through
28provision of agricultural worksite and home modification
29consultations, peer support services, services to families,
30information and referral, and equipment loan services.
   313.  Notwithstanding section 8.33, moneys appropriated in
32this section that remain unencumbered or unobligated at the
33close of the fiscal year shall not revert but shall remain
34available for expenditure for the purposes designated until the
35close of the succeeding fiscal year.

1   Sec. 8.  FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK.
  2There is appropriated from the general fund of the state to the
3department of agriculture and land stewardship for the fiscal
4year beginning July 1, 2019, and ending June 30, 2020, the
5following amount, or so much thereof as is necessary, to be
6used for the purposes designated:

13WATER QUALITY INITIATIVE
14   Sec. 9.  WATER QUALITY INITIATIVE — GENERAL.
   151.  There is appropriated from the general fund of the state
16to the department of agriculture and land stewardship for the
17fiscal year beginning July 1, 2019, and ending June 30, 2020,
18the following amount, or so much thereof as is necessary, to be
19used for the purposes designated:
   20For deposit in the water quality initiative fund created in
21section 466B.45, for purposes of supporting the water quality
22initiative administered by the division of soil conservation
23and water quality as provided in section 466B.42, including
24salaries, support, maintenance, and miscellaneous purposes:

   262.  a.  The moneys appropriated in subsection 1 shall be
27used to support projects in subwatersheds as designated by the
28division that are part of high-priority watersheds identified
29by the water resources coordinating council established
30pursuant to section 466B.3.
   31b.  The moneys appropriated in subsection 1 shall be used to
32support projects in watersheds generally, including regional
33watersheds, as designated by the division and high-priority
34watersheds identified by the water resources coordinating
35council established pursuant to section 466B.3.

   13.  In supporting projects in subwatersheds and watersheds
2as provided in subsection 2, all of the following shall apply:
   3a.  The demonstration projects shall utilize water quality
4practices as described in the Iowa nutrient reduction strategy
5as defined in section 455B.171.
   6b.  The division shall implement demonstration projects as
7provided in paragraph “a” by providing for participation by
8persons who hold a legal interest in agricultural land used in
9farming. To every extent practical, the division shall provide
10for collaborative participation by such persons who hold a
11legal interest in agricultural land located within the same
12subwatershed.
   13c.  The division shall implement a demonstration project on
14a cost-share basis as determined by the division. However,
15except for edge-of-field practices, the state’s share of the
16amount shall not exceed 50 percent of the estimated cost of
17establishing the practice as determined by the division or
1850 percent of the actual cost of establishing the practice,
19whichever is less.
   20d.  The demonstration projects shall be used to educate other
21persons about the feasibility and value of establishing similar
22water quality practices. The division shall promote field day
23events for purposes of allowing interested persons to establish
24water quality practices on their agricultural land.
   25e.  The division shall conduct water quality evaluations
26within supported subwatersheds. Within a reasonable period
27after accumulating information from such evaluations, the
28division shall create an aggregated database of water quality
29practices. Any information identifying a person holding a
30legal interest in agricultural land or specific agricultural
31land shall be a confidential record under section 22.7.
   324.  The moneys appropriated in subsection 1 shall be used
33to support education and outreach in a manner that encourages
34persons who hold a legal interest in agricultural land used for
35farming to implement water quality practices, including the
-6-1establishment of such practices in watersheds generally, and
2not limited to subwatersheds or high-priority watersheds.
   35.  The moneys appropriated in subsection 1 may be used
4to contract with persons to coordinate the implementation of
5efforts provided in this section.
   66.  The moneys appropriated in subsection 1 may be used by
7the department to support urban soil and water conservation
8efforts, which may include but are not limited to management
9practices related to bioretention, landscaping, the use of
10permeable or pervious pavement, and soil quality restoration.
11The moneys shall be allocated on a cost-share basis as provided
12in chapter 161A.
   137.  Notwithstanding any other provision of law to the
14contrary, the department may use moneys appropriated in
15subsection 1 to carry out the provisions of this section on a
16cost-share basis in combination with other moneys available to
17the department from a state or federal source.
   188.  Not more than 10 percent of the moneys appropriated in
19this section may be used to pay for the costs of administering
20and implementing the water quality initiative by the
21department’s division of soil conservation and water quality as
22provided in section 466B.42 and this section.
23DIVISION III
24department of natural resources
25   Sec. 10.  GENERAL FUND — DEPARTMENT.
   261.  There is appropriated from the general fund of the state
27to the department of natural resources for the fiscal year
28beginning July 1, 2019, and ending June 30, 2020, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated:
   31For purposes of supporting the department, including its
32divisions, for administration, regulation, and programs; for
33salaries, support, maintenance, and miscellaneous purposes; and
34for not more than the following full-time equivalent positions:

   22.  Of the number of full-time equivalent positions
3authorized to the department pursuant to subsection 1, 50
4full-time equivalent positions shall be allocated by the
5department for seasonal employees for purposes of providing
6maintenance, upkeep, and sanitary services at state parks.
7This subsection shall not impact park ranger or park manager
8positions within the department.
   93.  The department shall submit a report each quarter of the
10fiscal year to the legislative services agency, the department
11of management, the members of the joint appropriations
12subcommittee on agriculture and natural resources, and the
13chairpersons and ranking members of the senate and house
14committees on appropriations. The report shall describe in
15detail the expenditure of moneys appropriated under this
16section to support the department’s administration, regulation,
17and programs.
18   Sec. 11.  STATE FISH AND GAME PROTECTION FUND — REGULATION
19AND ADVANCEMENT OF OUTDOOR ACTIVITIES.
   201.  There is appropriated from the state fish and game
21protection fund created pursuant to section 456A.17 to the
22department of natural resources for the fiscal year beginning
23July 1, 2019, and ending June 30, 2020, the following amount,
24or so much thereof as is necessary, to be used for the purposes
25designated:
   26For purposes of supporting the regulation or advancement of
27hunting, fishing, or trapping, or the protection, propagation,
28restoration, management, or harvest of fish or wildlife,
29including for administration, regulation, law enforcement, and
30programs; and for salaries, support, maintenance, equipment,
31and miscellaneous purposes:

   332.  Notwithstanding section 455A.10, the department may use
34the unappropriated balance remaining in the state fish and game
35protection fund to provide for the funding of health and life
-8-1insurance premium payments from unused sick leave balances of
2conservation peace officers employed in a protection occupation
3who retire, pursuant to section 97B.49B.
   43.  Notwithstanding section 455A.10, the department of
5natural resources may use the unappropriated balance remaining
6in the state fish and game protection fund for the fiscal
7year beginning July 1, 2019, and ending June 30, 2020, as is
8necessary to fund salary adjustments for departmental employees
9for which the general assembly has made an operating budget
10appropriation in subsection 1.
11   Sec. 12.  GROUNDWATER PROTECTION FUND — WATER
12QUALITY.
  There is appropriated from the groundwater protection
13fund created in section 455E.11 to the department of natural
14resources for the fiscal year beginning July 1, 2019,
15and ending June 30, 2020, from those moneys which are not
16allocated pursuant to that section, the following amount, or
17so much thereof as is necessary, to be used for the purposes
18designated:

20of the state’s groundwater, including for administration,
21regulation, and programs, and for salaries, support,
22maintenance, equipment, and miscellaneous purposes:

28subsection 1 that remain unencumbered or unobligated at the
29close of the fiscal year shall not revert but shall remain
30available for expenditure for the purposes designated until the
31close of the succeeding fiscal year.
32   Sec. 16.  FORESTRY HEALTH MANAGEMENT.
   331.  There is appropriated from the general fund of the state
34to the department of natural resources for the fiscal year
35beginning July 1, 2019, and ending June 30, 2020, the following

17to Iowa state university of science and technology for the
18fiscal year beginning July 1, 2019, and ending June 30, 2020,
19the following amount, or so much thereof as is necessary, to be
20used for the purposes designated:
   21For purposes of supporting the college of veterinary
22medicine for the operation of the veterinary diagnostic
23laboratory and for not more than the following full-time
24equivalent positions:

   272.  a.  Iowa state university of science and technology
28shall not reduce the amount that it allocates to support the
29college of veterinary medicine from any other source due to the

33percentage of reduction imposed on the college of veterinary
34medicine is also imposed on all of Iowa state university of
35science and technology’s budget units.

   13.  If by June 30, 2020, Iowa state university of science and
2technology fails to allocate the moneys appropriated in this
3section to the college of veterinary medicine in accordance
4with this section, the moneys appropriated in this section for
5that fiscal year shall revert to the general fund of the state.
6DIVISION V
7environment first fund
8general appropriations
9   Sec. 18.  DEPARTMENT OF AGRICULTURE AND LAND
10STEWARDSHIP.
  There is appropriated from the environment first
11fund created in section 8.57A to the department of agriculture
12and land stewardship for the fiscal year beginning July 1,
132019, and ending June 30, 2020, the following amounts, or so
14much thereof as is necessary, to be used for the purposes
15designated:
   161.  CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP)
   17a.  For the conservation reserve enhancement program to
18restore and construct wetlands for the purposes of intercepting
19tile line runoff, reducing nutrient loss, improving water
20quality, and enhancing agricultural production practices:

   22b.  Not more than 10 percent of the moneys appropriated
23in paragraph “a” may be used for costs of administration and
24implementation of soil and water conservation practices.
   25c.  Notwithstanding any other provision in law, the
26department may use moneys appropriated in this subsection,

28fund appropriations, for cost sharing to match United States
29department of agriculture, natural resources conservation
30service, wetlands reserve enhancement program (WREP) funding
31available to Iowa.
   322.  WATERSHED PROTECTION
   33a.  For continuation of a program that provides
34multiobjective resource protections for flood control, water
35quality, erosion control, and natural resource conservation:

15to work with them to enhance their revegetation efforts to
16improve water quality and habitat:

   216.  SOIL AND WATER CONSERVATION
   22a.  For use by the department in providing for soil and water

   25b.  (1)  Of the amount appropriated in paragraph “a”, for
26transfer to the loess hills development and conservation fund
27created in section 161D.2:

   29(2)  (a)  Of the amount transferred to the loess hills

31shall be allocated to the fund’s hungry canyons account.
   32(b)  Not more than 5 percent of the moneys allocated to
33the fund’s hungry canyons account as provided in subparagraph
34division (a) may be used for administrative costs.
   35(3)  (a)  Of the amount transferred to the loess hills

2shall be allocated to the fund’s loess hills alliance account.
   3(b)  Not more than 10 percent of the moneys allocated to the
4fund’s loess hills alliance account as provided in subparagraph
5division (a) may be used for administrative costs.
   6c.  Of the remaining amount appropriated in paragraph “a”,
7for use by the department in providing for soil and water
8conservation administration, the conservation of soil and
9water resources, or the support of soil and water conservation
10districts:

   12d.  Of the amount appropriated in paragraph “c” that the
13department allocates to a soil and water conservation district,
14the first $15,000 may be expended by the district for the
15purpose of providing financial incentives under section 161A.73
16to establish management practices for the control of soil
17erosion on land that is row-cropped, including but not limited
18to nontill planting, ridge-till planting, and contouring
19strip-cropping. Of any remaining amount of that appropriation
20allocated by the department to a district, 30 percent may be
21expended by the district for that same purpose.
   22e.  Not more than 5 percent of the moneys appropriated in
23paragraph “c” may be allocated for cost sharing to address
24complaints filed under section 161A.47.
   25f.  Of the moneys appropriated in paragraph “c”, 5 percent
26shall be allocated for financial incentives to establish
27practices to protect watersheds above publicly owned lakes of
28the state from soil erosion and sediment as provided in section
29161A.73.
   30g.  The state soil conservation and water quality committee
31established by section 161A.4 may allocate moneys appropriated
32in paragraph “c” to conduct research and demonstration projects
33to promote conservation tillage and nonpoint source pollution
34control practices.
   35h.  The allocation of moneys as financial incentives as
-14-1provided in section 161A.73 may be used in combination with
2moneys allocated by the department of natural resources.
   3i.  Not more than 15 percent of the moneys appropriated
4in paragraph “c” may be used for costs of administration and
5implementation of soil and water conservation practices.
6   Sec. 19.  DEPARTMENT OF NATURAL RESOURCES.  There is
7appropriated from the environment first fund created in section
88.57A to the department of natural resources for the fiscal
9year beginning July 1, 2019, and ending June 30, 2020, the
10following amounts, or so much thereof as is necessary, to be
11used for the purposes designated:

   13a.  For regular maintenance and operations of state parks and
14staff time associated with these activities:

13   Sec. 20.  STATE UNIVERSITY OF IOWA GEOGRAPHICAL
14SURVEY.
  There is appropriated from the environment first
15fund created in section 8.57A to the state university of Iowa
16for the fiscal year beginning July 1, 2019, and ending June
1730, 2020, the following amounts, or so much thereof as is
18necessary, to be used for the purposes designated:
   191.  OPERATIONS
   20For purposes of supporting the operations of the geological
21survey of the state as created within the state university
22of Iowa pursuant to section 456.1, including but not limited
23to providing analysis; data maintenance, collection, and
24compilation; investigative programs; and information for water
25supply development and protection:

29measuring, assessing, and evaluating the quantity of water
30sources in this state and assisting the department of natural

35   Sec. 21.  REVERSION.

  11.  a.  Except as provided in paragraph “b”, and
2notwithstanding section 8.33, moneys appropriated for the
3fiscal year beginning July 1, 2019, in this division of this
4Act that remain unencumbered or unobligated at the close of the
5fiscal year shall not revert but instead shall remain available
6to be used for the purposes designated until the close of the
7succeeding fiscal year, or until the project for which the
8appropriation was made is completed, whichever is earlier.
   9b.  Notwithstanding section 8.33, moneys appropriated for
10the fiscal year beginning July 1, 2019, in this division of
11this Act to the department of agriculture and land stewardship
12to provide financial assistance for the establishment of
13permanent soil and water conservation practices that remain
14unencumbered or unobligated at the close of the fiscal year
15shall not revert but instead shall remain available for
16expenditure for the purposes designated until the close of the
17fiscal year beginning July 1, 2022.
   182.  Subsection 1 does not apply to moneys transferred
19pursuant to this division to the loess hills development and
20conservation fund created in section 161D.2 which shall not
21revert as provided in that section.
22DIVISION VI
23ENVIRONMENT FIRST FUND
24SPECIAL APPROPRIATIONS
25   Sec. 22.  WATER QUALITY INITIATIVE — DEPARTMENT OF
26AGRICULTURE AND LAND STEWARDSHIP.
   271.  There is appropriated from the environment first fund
28created in section 8.57A to the department of agriculture
29and land stewardship for the fiscal year beginning July 1,
302019, and ending June 30, 2020, the following amount, or so
31much thereof as is necessary, to be used for the purposes
32designated:
   33For deposit in the water quality initiative fund created in
34section 466B.45, for purposes of supporting the water quality
35initiative administered by the division of soil conservation
-17-1and water quality as provided in section 466B.42, including
2salaries, support, maintenance, and miscellaneous purposes:

   42.  a.  The moneys appropriated in subsection 1 shall be
5used to support projects in subwatersheds as designated by the
6division that are part of high-priority watersheds identified
7by the water resources coordinating council established
8pursuant to section 466B.3.
   9b.  The moneys appropriated in subsection 1 shall be used to
10support projects in watersheds generally, including regional
11watersheds, as designated by the division and high-priority
12watersheds identified by the water resources coordinating
13council established pursuant to section 466B.3.
   143.  In supporting projects in subwatersheds and watersheds
15as provided in subsection 2, all of the following shall apply:
   16a.  The demonstration projects shall utilize water quality
17practices as described in the Iowa nutrient reduction strategy
18as defined in section 455B.171.
   19b.  The division shall implement demonstration projects as
20provided in paragraph “a” by providing for participation by
21persons who hold a legal interest in agricultural land used in
22farming. To every extent practical, the division shall provide
23for collaborative participation by such persons who hold a
24legal interest in agricultural land located within the same
25subwatershed.
   26c.  The division shall implement a demonstration project on
27a cost-share basis as determined by the division. However,
28except for edge-of-field practices, the state’s share of the
29amount shall not exceed 50 percent of the estimated cost of
30establishing the practice as determined by the division or
3150 percent of the actual cost of establishing the practice,
32whichever is less.
   33d.  The demonstration projects shall be used to educate other
34persons about the feasibility and value of establishing similar
35water quality practices. The division shall promote field day
-18-1events for purposes of allowing interested persons to establish
2water quality practices on their agricultural land.
   3e.  The division shall conduct water quality evaluations
4within supported subwatersheds. Within a reasonable period
5after accumulating information from such evaluations, the
6division shall create an aggregated database of water quality
7practices. Any information identifying a person holding a
8legal interest in agricultural land or specific agricultural
9land shall be a confidential record under section 22.7.
   104.  The moneys appropriated in subsection 1 shall be used
11to support education and outreach in a manner that encourages
12persons who hold a legal interest in agricultural land used for
13farming to implement water quality practices, including the
14establishment of such practices in watersheds generally, and
15not limited to subwatersheds or high-priority watersheds.
   165.  The moneys appropriated in subsection 1 may be used
17to contract with persons to coordinate the implementation of
18efforts provided in this section.
   196.  The moneys appropriated in subsection 1 may be used by
20the department to support urban soil and water conservation
21efforts, which may include but are not limited to management
22practices related to bioretention, landscaping, the use of
23permeable or pervious pavement, and soil quality restoration.
24The moneys shall be allocated on a cost-share basis as provided
25in chapter 161A.
   267.  Notwithstanding any other provision of law to the
27contrary, the department may use moneys appropriated in
28subsection 1 to carry out the provisions of this section on a
29cost-share basis in combination with other moneys available to
30the department from a state or federal source.
   318.  Not more than 10 percent of the moneys appropriated in
32this section may be used to pay for the costs of administering
33and implementing the water quality initiative by the
34department’s division of soil conservation and water quality as
35provided in section 466B.42 and this section.

1   Sec. 23.  REAP — IN LIEU OF GENERAL FUND APPROPRIATION.In
2lieu of the standing appropriation in section 455A.18, there is
3appropriated from the environment first fund created in section
48.57A to the Iowa resources enhancement and protection fund
5for the fiscal year beginning July 1, 2019, and ending June
630, 2020, the following amount, to be allocated as provided in

11STEWARDSHIP — PROGRAMS TO AUDIT MOTOR FUEL
12   Sec. 24.  NEW SECTION.  214A.2C  Auditing programs.
   13The department shall establish and administer programs
14for the auditing of motor fuel including biofuel processing
15and production plants, for screening and testing motor fuel,
16including renewable fuel, and for the inspection of motor fuel
17sold by dealers, including retail dealers who sell and dispense
18motor fuel from motor fuel pumps.

20RELATED CODE CHANGES — STATE UNIVERSITY OF IOWA — IOWA
21GEOLOGICAL SURVEY
22   Sec. 25.  Section 352.4, subsection 4, Code 2019, is amended
23to read as follows:
   244.  The state department of agriculture and land
25stewardship, department of management, department of natural
26resources, Iowa geological survey, state agricultural extension
27service, and the economic development authority shall, upon
28request, provide to each county commission any pertinent land
29use information available to assist in the compiling of the
30county land use inventories.
31   Sec. 26.  Section 456.1, Code 2019, is amended to read as
32follows:
   33456.1  Geological Iowa geological survey created.
   34A An Iowa geological survey of the state is created within
35the state university of Iowa, under the jurisdiction and

2   Sec. 27.  Section 456.10, Code 2019, is amended to read as
3follows:
   4456.10  Distribution of reports.
   5All publications of the Iowa geological survey shall be made
6available electronically via an internet site maintained for
7that purpose.
8   Sec. 28.  Section 456.13, Code 2019, is amended to read as
9follows:
   10456.13  Maps property of state — custody — copies.
   11The maps so delivered to the state geologist shall be the
12property of the state and shall remain in the custody of the
13state geologist. They shall be kept at the office of the Iowa
14 geological survey and be open to examination by all persons
15interested in the maps; but such examination shall only be made
16in the presence of the state geologist or a designee, and the
17state geologist shall not permit any copies of the maps to be
18made without the written consent of the operator or the owner
19of the property, except as provided in section 456.11 or if the
20mine has been abandoned for at least five years.
21DIVISION IX
22WAREHOUSE OPERATORS — LIEN
23   Sec. 29.  Section 554.7209, Code 2019, is amended by adding
24the following new subsection:
25   NEW SUBSECTION.  3A.  Notwithstanding any provision in
26this section to the contrary, a warehouse’s lien created in
27subsection 1, that is in favor of a warehouse operator licensed
28under either chapter 203C or the United States Warehouse Act, 7
29U.S.C. ch.10, is effective against all persons and is superior
30against all other competing security interests and agricultural
31liens.
32   Sec. 30.  EFFECTIVE DATE.  This division of this Act, being
33deemed of immediate importance, takes effect upon enactment.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with
-21-1the explanation’s substance by the members of the general assembly.
   2GENERAL. This bill relates to agriculture and natural
3resources by making appropriations for the fiscal year
42019-2020 to support related entities, including the department
5of agriculture and land stewardship (DALS), the department of
6natural resources (DNR), and Iowa state university (ISU), and
7the university of Iowa (UI).
   8The bill primarily appropriates moneys to DALS and DNR.
9 The appropriations are made to support those departments for
10administration, regulation, and support of programs. The bill
11requires the departments to submit quarterly reports to the
12general assembly and department of management regarding the
13expenditure of appropriated moneys. The bill also provides
14moneys to support specific programs or projects administered
15by those departments. The bill appropriates moneys from a
16number of sources, including the general fund of the state
17(general fund), the state fish and game protection fund, the
18groundwater protection fund, and the environment first fund
19(EFF). Appropriations are made from a number of sources to
20support the water quality initiative (WQI). The bill is
21organized into divisions.
   22DALS — GENERAL FUND APPROPRIATIONS. The bill appropriates
23moneys to DALS from the general fund in order to support its
24administrative divisions, including consumer protection and
25industry services, soil conservation, and food safety and
26animal health. Moneys are transferred to ISU to support its
27midwest grape and wine institute. Moneys are also transferred
28to ISU to support the college of veterinary medicine for the
29operation of the veterinary diagnostic laboratory, contingent
30upon the enactment of 2019 Iowa Acts, senate file 601.
   31DALS — MISCELLANEOUS FUNDS — DESIGNATED APPROPRIATIONS.
32 The bill appropriates moneys from several sources to support a
33number of designated purposes, including moneys derived from
34unclaimed winnings from horse and dog races, for administration
35and enforcement of racing regulations; and moneys credited
-22-1to the renewable fuel infrastructure fund, for purposes of
2regulating motor fuel.
   3DALS — SPECIAL GENERAL FUND APPROPRIATIONS. The bill also
4makes special appropriations from the general fund to DALS in
5order to support specific purposes including milk inspection,
6the local food and farm program, an agricultural education
7organization, assistance to farmers with disabilities, and for
8foreign animal disease preparedness.
   9DALS — GENERAL FUND APPROPRIATIONS — WATER QUALITY. The
10bill appropriates moneys from the general fund to DALS for
11deposit in the water quality initiative fund, to support the
12WQI including high-priority watershed projects. The bill
13appropriates moneys from the general fund to DALS for deposit
14in the agricultural drainage well water quality assistance fund
15for purposes of supporting the agricultural drainage well water
16quality assistance program.
   17DNR — GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS.
18 The bill makes appropriations from a number of funds to DNR in
19order to support its administrative divisions involving natural
20resources and environmental protection from the general fund,
21the state fish and game protection fund, and the groundwater
22protection fund.
   23DNR — MISCELLANEOUS FUNDS — DESIGNATED APPROPRIATIONS.
24 The bill appropriates moneys to DNR from a number of sources
25to support designated purposes, including moneys deposited in
26the special snowmobile fund to provide for administering and
27enforcing the state snowmobile programs; and moneys deposited
28in the unassigned revenue fund for purposes of paying for
29administration of DNR’s underground storage tanks section.
   30DNR — SPECIAL GENERAL FUND APPROPRIATIONS. The bill also
31makes special appropriations from the general fund to DNR
32in order to support specific purposes including floodplain
33management and dam safety and forestry health management
34programs.
   35ISU — SPECIAL GENERAL FUND APPROPRIATIONS. The bill
-23-1appropriates moneys from the general fund to ISU to support the
2operation of its veterinary diagnostic laboratory.
   3DALS, DNR, AND UI — EFF — GENERAL APPROPRIATIONS. The
4bill appropriates moneys from the EFF to support a number of
5programs administered by DALS, DNR, and UI. For DALS, the
6moneys are appropriated to support programs involving soil
7conservation, watershed protection and nutrient management,
8and the loess hills development and conservation fund. For
9DNR, moneys are appropriated to support programs involving
10state parks, geographic information systems, water quality
11monitoring, public water supplies, regulation of animal feeding
12operations, air quality, and floodplain management and dam
13safety. For UI, moneys are appropriated to support the Iowa
14geological survey. The bill includes provisions that delay the
15reversion of these moneys.
   16EFF — SPECIAL APPROPRIATIONS FOR WQI. The bill
17appropriates moneys from the EFF to the water quality
18initiative fund subject to the same conditions applicable to
19moneys appropriated to the fund from the general fund.
   20IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND — EFF
21APPROPRIATION IN LIEU OF GENERAL FUND APPROPRIATION. An amount
22of moneys is appropriated from the EFF to the REAP fund instead
23of the $20,0000 otherwise required to be appropriated to the
24fund from the general fund.
   25RELATED CODE CHANGES — IOWA GEOLOGICAL SURVEY. The name
26of the geological survey of the state is changed to the Iowa
27geological survey to comply with current naming conventions.
   28RELATED CODE CHANGES — PROGRAMS TO AUDIT MOTOR FUEL. The
29provisions in the bill that authorize DALS to establish and
30administer programs for auditing motor fuel production and
31processing, motor fuel screening and testing, and inspection of
32motor fuel sold by dealers is codified. The provision has been
33included in previous appropriation bills since 2006.
   34RELATED CODE CHANGES — WAREHOUSE OPERATORS LIEN. The bill
35provides that a grain warehouse operator possessing grain has a

2upon enactment.
