3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  232.108A  Suspension of child
2support order — child in need of assistance proceedings.
   3If, at any time during the judicial proceedings following
4the filing of a petition pursuant to section 232.87, the
5custody or physical care of a child is granted to a party who is
6obligated to pay support for the child under an existing child
7support order entered under chapter 234, 252A, 252C, 252F,
8598, or 600B, or any other chapter, the juvenile court shall
9issue a notice to the appropriate district court requesting
10suspension of any existing child support obligation for the
11party relating to the child. Upon receipt by the district
12court of the notice and documentation that established any
13such existing child support obligation, the district court
14shall suspend the support obligation of the party. If,
15pursuant to an order issued by the juvenile court, the child
16is subsequently returned to the child’s home, the district
17court shall reinstate the support obligation of the party
18obligated to pay support for the child prior to the suspension
19as specified in this section.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill requires that if, at any time during the judicial
24proceedings following the filing of a petition to determine
25if a child is a child in need of assistance, the custody
26or physical care of a child is granted to a party who is
27obligated to pay support for the child under an existing child
28support order, the juvenile court shall issue a notice to
29the appropriate district court requesting suspension of any
30existing child support obligation for the party relating to the
31child. Upon receipt by the district court of the notice and
32documentation that established any such existing child support
33obligation, the district court shall suspend the support
34obligation of the party. If, pursuant to an order issued by
35the juvenile court, the child is subsequently returned to the

3prior to the suspension.
