3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 714.1, subsection 1, Code 2019, is
2amended to read as follows:
31. Takes possession or control of the property of another,
4or property in the possession of another, with the intent to
5deprive the other thereof. In the case of a motor vehicle as
6defined in chapter 321, depriving another of the possession or
7control of a motor vehicle for six or more hours establishes
8the intent to deprive the other person of possession or control
9of such property.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
13This bill relates to theft and the intent to deprive a person
14of the possession or control of certain property.
15The bill provides that in the case of a motor vehicle
16as defined in Code chapter 321, depriving another of the
17possession or control of a motor vehicle for six or more
18hours establishes the intent to deprive the other person of
19possession or control of such property.
20Theft of a motor vehicle carries a penalty from a class “C”
21felony down to a simple misdemeanor depending on the value of
22the motor vehicle.
