4registry.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 235A.15, subsection 2, paragraph c, Code
22019, is amended by adding the following new subparagraph:
3   NEW SUBPARAGRAPH.  (15)  To an administrator of a child care
4home as defined under chapter 237 if the data concerns a person
5employed or being considered for employment by the child care
6home.
7   Sec. 2.  Section 237A.5, subsection 2, paragraph a,
8subparagraph (1), Code 2019, is amended by adding the following
9new subparagraph division:
10   NEW SUBPARAGRAPH DIVISION.  (f)  The person is being
11considered by a child care home for employment involving direct
12responsibility for a child or with access to a child when
13the child is alone or when the person is employed with such
14responsibilities.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill relates to background checks for persons being
19considered for employment by a child care home.
   20Code section 235A.15 grants authorized access to the
21child abuse registry to certain departments, agencies, and
22individuals. The bill authorizes access to the child abuse
23registry to an administrator of a child care home as defined
24under Code chapter 237 if the data concerns a person employed
25or being considered for employment by the child care home.
   26Code section 237A.5 requires certain persons being
27considered for licensure or registration as a child care home
28to be subject to a record check. Under current law, child care
29homes are not required to be licensed and registered if the
30child care home provides care for five or fewer children. The
31bill provides that a person who is being considered by a child
32care home for employment involving direct responsibility for
33a child or with access to a child when the child is alone or
34when the person is employed with such responsibilities shall
35be subject to a record check.
