3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 234.12A, Code 2019, is amended by adding
2the following new subsections:
3   NEW SUBSECTION.  2A.  A person who possesses three or more
4electronic benefit transfer cards for which the person is
5not authorized to possess is guilty of a fraudulent practice
6pursuant to section 234.13, subsection 4.
7   NEW SUBSECTION.  2B.  A law enforcement officer who has
8probable cause to believe that a person possesses an electronic
9benefits transfer card that the person is not authorized
10to possess shall report the name on the electronic benefit
11transfer card and the name of the person in possession of
12the electronic benefits transfer card to the department of
13inspections and appeals.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to electronic benefits transfer (EBT)
18cards under the food assistance program and makes penalties
19applicable.
   20The bill provides that a person who possesses three or more
21EBT cards for which the person is not authorized to possess
22is guilty of a fraudulent practice pursuant to Code section
23234.13(4) (fraudulent practices relating to food programs).
   24The bill provides that a law enforcement officer who has
25probable cause to believe that a person possesses an EBT card
26that the person is not authorized to possess shall report the
27name on the EBT card and the name of the person in possession of
28the card to the department of inspections and appeals.
