4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  280.16B  Student seizure training
2and response — administration of medication.
   31.  For purposes of this section:
   4a.  “Licensed health care professional” means the same as
5provided in section 280.16.
   6b.  “Seizure action plan” means a written, individualized
7health plan designed to acknowledge and prepare for the health
8care needs of a student diagnosed with a seizure disorder.
   9c.  “Seizure medication” means medication approved by the
10United States food and drug administration or any successor
11agency and prescribed to a student by a licensed health care
12professional to treat seizure disorder symptoms, including
13medication to be administered on an emergency basis.
   142.  The board of directors of a school district and the
15authorities in charge of an accredited nonpublic school shall
16have at least one employee at each attendance center who has
17received instruction on administering or assisting with the
18self-administration of seizure medication.
   193.  Instruction pursuant to subsection 2 shall include
20instruction on administering seizure medication and recognizing
21the signs and symptoms of seizures and the appropriate steps
22to be taken to respond to such signs and symptoms. Such
23instruction shall be fully consistent with training programs
24developed by the epilepsy foundation of America or any
25successor organization.
   264.  The parent or guardian of a student prescribed seizure
27medication shall do all of the following to enable a school
28employee to administer seizure medication to or assist with the
29self-administration of seizure medication by the student:
   30a.  Provides the school district or school each school
31year with a written authorization in a form prescribed by the
32school district or school to administer the medication at an
33attendance center or other school function.
   34b.  Provides the school district or school each school
35year with a written statement from a licensed health care
-1-1professional that contains all of the following information:
   2(1)  The student’s name.
   3(2)  The name and purpose of the medication.
   4(3)  The prescribed dosage of the medication.
   5(4)  The route of administration of the medication.
   6(5)  The frequency that the medication may be administered.
   7(6)  The circumstances under which the medication may be
8administered.
   9c.  Provides the seizure medication to the school district or
10school in its unopened, sealed package with the label affixed
11by the dispensing pharmacy intact and replaces the seizure
12medication upon depletion or expiration.
   13d.  Collaborates with school district or school personnel to
14create a seizure action plan for the student.
   155.  The school district or school shall keep the written
16statements and seizure action plan pursuant to subsection
174, paragraphs “a” and “b”, on file. The school district or
18school shall distribute the seizure action plan to any school
19personnel or volunteers responsible for the supervision or care
20of the student.
   216.  Every school district or school shall provide an
22age-appropriate seizure education program to all students
23on seizures and seizure disorders. The program shall be
24consistent with guidelines published by the epilepsy foundation
25of America or any successor organization.
   267.  The board of directors of a school district and the
27authorities in charge of an accredited nonpublic school shall
28require a minimum of one hour of self-study review of training
29materials on recognition of and appropriate response to seizure
30disorders by each principal, guidance counselor, and teacher
31each school year.
   328.  The department of education, in consultation with the
33board of medicine, the board of nursing, and the board of
34physician assistants, shall adopt rules pursuant to chapter
3517A to administer this section, including but not limited to
-2-1rules establishing standards for the development and content of
2seizure action plans, content for instruction required pursuant
3to subsection 2, and content for self-study review pursuant to
4subsection 7.
5   Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
6with section 25B.2, subsection 3, the state cost of requiring
7compliance with any state mandate included in this Act shall
8be paid by a school district from state school foundation aid
9received by the school district under section 257.16. This
10specification of the payment of the state cost shall be deemed
11to meet all of the state funding-related requirements of
12section 25B.2, subsection 3, and no additional state funding
13shall be necessary for the full implementation of this Act
14by and enforcement of this Act against all affected school
15districts.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill requires school boards and authorities in charge
20of accredited nonpublic schools to have at least one employee
21at each attendance center who has received instruction on
22administering or assisting with the self-administration of
23seizure medication.
   24Such instruction shall include instruction on administering
25seizure medication and recognizing the signs and symptoms of
26seizures and the appropriate steps to be taken to respond to
27such signs and symptoms and shall be fully consistent with
28training programs developed by the epilepsy foundation of
29America or any successor organization.
   30The bill defines “seizure medication” as medication approved
31by the United States food and drug administration or any
32successor agency and prescribed to a student by a licensed
33health care professional to treat seizure disorder symptoms,
34including medication to be administered on an emergency basis.
   35The bill requires the parent or guardian of a student

2the bill to enable a school employee to administer seizure
3medication to or assist with the self-administration of seizure
4medication by the student.
   5The parent or guardian must provide the school district
6or school each school year with a written authorization to
7administer the medication at an attendance center or other
8school function. The parent or guardian must provide the
9school district or school each school year with a written
10statement from a licensed health care professional that
11contains specified information about the student’s seizure
12medication. The parent or guardian must provide the seizure
13medication to the school district or school in its unopened,
14sealed package with the label affixed by the dispensing
15pharmacy intact and replace the seizure medication upon
16depletion or expiration. The parent or guardian must
17collaborate with school district or school personnel to create
18a seizure action plan for the student. The bill defines
19“seizure action plan” as a written, individualized health plan
20designed to acknowledge and prepare for the health care needs
21of a student diagnosed with a seizure disorder. The school
22district or school is required to distribute the seizure action
23plan to any school personnel or volunteers responsible for the
24supervision or care of the student.
   25The bill requires every school district and accredited
26nonpublic school to provide an age-appropriate seizure
27education program to all students on seizures and seizure
28disorders. The program shall be consistent with guidelines
29published by the epilepsy foundation of America or any
30successor organization.
   31The bill requires school boards and authorities in charge
32of accredited nonpublic schools to require a minimum of one
33hour of self-study review of training materials on recognition
34of and appropriate response to seizure disorders by each
35principal, guidance counselor, and teacher each school year.

   1The bill requires the department of education, in
2consultation with the board of medicine, the board of nursing,
3and the board of physician assistants, to adopt rules to
4administer the bill.
   5The bill may include a state mandate as defined in Code
6section 25B.3. The bill requires that the state cost of
7any state mandate included in the bill be paid by a school
8district from state school foundation aid received by the
9school district under Code section 257.16. The specification
10is deemed to constitute state compliance with any state mandate
11funding-related requirements of Code section 25B.2. The
12inclusion of this specification is intended to reinstate the
13requirement of political subdivisions to comply with any state
14mandates included in the bill.
