House Study Bill 233 - IntroducedA Bill ForAn Act 1relating to the power of cities to regulate certain
2building restrictions.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 414.1, subsection 1, Code 2019, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  c.  A city shall not, after January 1,
42019, adopt or enforce any regulation, restriction, or other
5ordinance related to residential property rental permit caps on
6single-family homes or duplexes.
7   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
8importance, takes effect upon enactment.
9   Sec. 3.  RETROACTIVE APPLICABILITY.  This Act applies
10retroactively to January 1, 2019, to regulations, restrictions,
11or ordinances adopted on or after that date.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
   15This bill relates to powers granted to a city concerning
16building restrictions. The bill prohibits a city from
17adopting or enforcing a regulation, restriction, or other
18ordinance related to residential property rental permit caps
19on single-family homes or duplexes after January 1, 2019. The
20bill is effective upon enactment and applies retroactively to
21regulations, restrictions, or ordinances adopted or enforced
22on or after that date.
