3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  27A.12  Data collection.
   2Each state or local law enforcement agency subject to this
3chapter shall do all of the following:
   41.  Collect data relating to the commission of public
5offenses by nonresident aliens as defined in section 9I.1.
6Data collected shall include but is not limited to:
   7a.  Whether a citation was issued or an arrest was made.
   8b.  The type of citation issued or the basis for the arrest.
   9c.  Whether the public offense was a misdemeanor or felony.
   10d.  Whether the public offense was committed against another
11person.
   12e.  Injuries sustained by another person or a law enforcement
13officer as a result of or in the course of committing the
14public offense.
   15f.  The type of property seized pursuant to an arrest.
   162.  Data collected pursuant to this section shall be
17submitted to the division of criminal and juvenile justice
18planning of the department of human rights as directed by the
19division.
20   Sec. 2.  Section 216A.131A, Code 2019, is amended to read as
21follows:
   22216A.131A  Division of criminal and juvenile justice planning.
   23The division of criminal and juvenile justice planning is
24established to fulfill the responsibilities of this subchapter,
25including the duties specified in sections 216A.135, 216A.136,
26216A.137, 216A.138, and 216A.139, and 216A.140A.
27   Sec. 3.  NEW SECTION.  216A.140A  Nonresident alien public
28offense research project.
   291.  The division shall establish and maintain a nonresident
30alien public offense research project to conduct analyses and
31evaluate the public offense data submitted to the division
32pursuant to section 27A.12.
   332.  The division shall submit an annual report to the general
34assembly by January 31 of each year regarding research results
35and the status of the project.

1EXPLANATION
2The inclusion of this explanation does not constitute agreement with

   4This bill relates to nonresident alien public offense data
5collection and analysis.
   6The bill provides that each state or local law enforcement
7agency subject to Code chapter 27A must collect data relating
8to the commission of public offenses by nonresident aliens as
9defined in Code section 9I.1. Data collected shall include
10whether a citation was issued or an arrest was made, the
11type of citation issued or the basis for the arrest, whether
12the public offense was a misdemeanor or felony, whether the
13public offense was committed against another person, injuries
14sustained by another person or a law enforcement officer as a
15result of the public offense, and the type of property seized
16pursuant to an arrest.
   17The bill requires the public offense data to be submitted to
18the division of criminal and juvenile justice planning of the
19department of human rights as directed by the division. The
20bill provides that the division shall establish and maintain a
21nonresident alien public offense research project to conduct
22analyses and evaluate the public offense data submitted to the
23division by state and local law enforcement agencies. The
24division must submit an annual report to the general assembly
25by January 31 of each year regarding the research results and
26project status.
