3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  455B.199D  Lagoon-based wastewater
2treatment systems — upgrades and expansion.
   31.  For purposes of this section, “municipality” means the
4same as defined in section 455B.29.
   52.  The department shall provide a person offering
6wastewater disposal or treatment services to a municipality or
7other community currently served by a lagoon-based wastewater
8treatment works with information regarding options to upgrade
9or expand the existing lagoon-based wastewater treatment works
10to meet discharge requirements. The information provided shall
11include available advanced technologies including biological
12treatment options.
   133.  The person offering wastewater disposal or treatment
14services shall conduct an analysis of available options to meet
15wastewater discharge requirements, including the construction
16or installation of a new wastewater collection or treatment
17facility, connection to an existing wastewater collection or
18treatment facility outside the municipality or community, and
19upgrading or expanding the existing wastewater collection or
20treatment system. The analysis shall include an examination of
21the feasibility and the cost of each option.
   224.  If upgrading or expanding the existing wastewater
23treatment system is feasible and cost effective and will enable
24the system to meet the discharge requirements, the department
25shall provide for a necessary variance to regulation in the
26same manner as provided in section 455B.199B to allow the
27entity to implement such option.
28EXPLANATION
29The inclusion of this explanation does not constitute agreement with
30the explanation’s substance by the members of the general assembly.
   31This bill requires the department of natural resources to
32provide information regarding options to upgrade the existing
33treatment works to meet discharge requirements to a person
34offering wastewater disposal or treatment services to a
35municipality or community currently served by a lagoon-based

2available advanced technologies including biological treatment
3options. The person shall conduct an analysis, including
4feasibility and cost, of available options to meet the
5discharge requirements. If upgrading or expanding the existing
6system is feasible, cost effective, and will meet the discharge
7requirements, the department shall provide for a necessary
8variance to regulation in the same manner as provided in Code
9section 455B.199B to allow the person to implement the option.
