Senate Study Bill 1189 - IntroducedA Bill ForAn Act 1relating to tobacco cessation services under the

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  TOBACCO CESSATION SERVICES — MEDICAID
2PROGRAM.
  The department of human services shall contractually
3and by administrative rules adopted pursuant to chapter 17A
4require, under Medicaid fee-for-service and Medicaid managed
5care administration, that a Medicaid member, who contacts
6the member’s Medicaid managed care organization’s tobacco
7cessation program or Quitline Iowa seeking tobacco cessation
8services, shall be eligible to receive tobacco cessation
9services without prior authorization. For the purposes of this
10section, “tobacco cessation services” includes counseling, oral
11smoking cessation therapy, and nicotine replacement therapy, as
12applicable to the member’s situation.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill requires the department of human services (DHS)
17to contractually and by administrative rules adopted pursuant
18to chapter 17A require, under Medicaid fee-for-service and
19Medicaid managed care administration, that a Medicaid member,
20who contacts the member’s Medicaid managed care organization’s
21tobacco cessation program or Quitline Iowa seeking tobacco
22cessation services, shall be eligible to receive tobacco
23cessation services without prior authorization. The bill
24defines “tobacco cessation services” as counseling, oral
25smoking cessation therapy, and nicotine replacement therapy, as
26applicable to the member’s situation.
