3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  68A.507  Employer control of
2employee contributions prohibited.
   31.  An employer employing persons in Iowa shall not do any
4of the following:
   5a.  Prohibit an employee or a family member of an employee
6from making a contribution to a committee.
   7b.  Require an employee or a family member of an employee to
8receive approval prior to making a contribution to a committee.
   9c.  Limit the amount of any contribution an employee or a
10family member of an employee makes to a committee.
   11d.  Take any adverse action against an employee for an
12employee’s contributing to or failing to contribute to a
13committee or for a family member of an employee contributing or
14failing to contribute to a committee.
   152.  This section does not prohibit an employer from
16prohibiting an employee from making a contribution that would
17be a violation of a federal or state law or regulation. Such
18a policy shall not exceed the requirements of the relevant
19federal or state law or regulation.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill prohibits an employer who employs people in Iowa
24from prohibiting, limiting, or requiring approval for the
25contributions of employees or family members of employees to
26political committees or candidates’ committees. The bill does
27not prohibit an employer from maintaining a policy limiting
28those contributions that violate a federal or state law or
29regulation. By operation of law, a person who violates the
30bill is guilty of a serious misdemeanor. A serious misdemeanor
31is punishable by confinement for no more than one year and a
32fine of at least $315 but not more than $1,875.
