2anatomical donor symbols on certain licenses.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  SHORT TITLE.  This Act shall be known as “Logan’s
2Law”.
3   Sec. 2.  Section 142C.2, subsection 6, Code 2019, is amended
4to read as follows:
   56.  “Document of gift” means a donor card or other record
6used to make an anatomical gift, including a statement or
7symbol on a driver’s license, or identification card, or
8hunting, fishing, or fur harvester license,
or an entry in a
9donor registry.
10   Sec. 3.  Section 142C.2, Code 2019, is amended by adding the
11following new subsection:
12   NEW SUBSECTION.  13A.  “Hunting, fishing, or fur harvester
13license”
means a license issued by the department of natural
14resources or an authorized license agent pursuant to chapter
15483A.
16   Sec. 4.  Section 142C.3, subsection 1, paragraph a, Code
172019, is amended by adding the following new subparagraph:
18   NEW SUBPARAGRAPH.  (4)  A minor, if the minor is authorized
19under state law to apply for a hunting, fishing, or fur
20harvester license, the minor is at least 14 years of age, and
21the minor authorizes a symbol indicating an anatomical gift on
22a hunting, fishing, or fur harvester license with the signed
23approval of a parent or guardian.
24   Sec. 5.  Section 142C.3, subsection 2, paragraph a, Code
252019, is amended by adding the following new subparagraph:
26   NEW SUBPARAGRAPH.  (02)  By authorizing a symbol indicating
27that the donor has made an anatomical gift to be imprinted on
28the donor’s hunting, fishing, or fur harvester license.
29   Sec. 6.  Section 142C.3, subsection 2, paragraph c, Code
302019, is amended to read as follows:
   31c.  Revocation, suspension, expiration, or cancellation of a
32driver’s license, or identification card, or hunting, fishing,
33or fur harvester license
upon which an anatomical gift is
34indicated shall not invalidate the gift.
35   Sec. 7.  Section 142C.8, subsections 1 and 2, Code 2019, are
-1-1amended to read as follows:
   21.  When a hospital refers an individual at or near death
3to a procurement organization, the procurement organization
4shall make a reasonable search of the records of the state
5department of transportation, department of natural resources,
6 and any donor registry that the hospital knows exists for the
7geographical area in which the individual resides to ascertain
8whether the individual has made an anatomical gift.
   92.  A procurement organization shall be allowed reasonable
10access to information in the records of the state department
11of transportation and the department of natural resources to
12ascertain whether an individual at or near death is a donor.
13   Sec. 8.  Section 142C.18, Code 2019, is amended by adding the
14following new subsection:
15   NEW SUBSECTION.  2A.  The department of natural resources
16shall cooperate with a person that administers the Iowa donor
17registry for the purpose of transferring to the donor registry
18all relevant information regarding a donor’s making of an
19anatomical gift.
20   Sec. 9.  Section 142C.18, subsection 3, paragraph d, Code
212019, is amended to read as follows:
   22d.  Provide a centralized, automated system to compile
23donation information received by the state department of
24transportation, department of natural resources, county
25treasurers, and the Iowa donor network.
26   Sec. 10.  Section 483A.10, Code 2019, is amended by adding
27the following new subsection:
28   NEW SUBSECTION.  3.  An application for a hunting, fishing,
29or fur harvester license shall include a section where an
30applicant may request that the applicant’s license include a
31symbol that indicates that the applicant is a donor under the
32revised uniform anatomical gift Act as provided in chapter
33142C.
34   Sec. 11.  Section 483A.18, Code 2019, is amended to read as
35follows:
-2-   1483A.18  Form of licenses.
   21.  All hunting, fishing, and fur harvester licenses shall
3contain a general description of the licensee. Such licenses
4shall be upon such forms as the commission shall adopt. The
5address and the signature of the applicant and all signatures
6and other required information shall be in writing. All
7licenses shall clearly indicate the nature of the privilege
8granted.
   92.  Upon request of an applicant pursuant to section 483A.10,
10the department shall indicate on the license that the applicant
11is a donor under the revised uniform anatomical gift Act as
12provided in chapter 142C.
13   Sec. 12.  Section 483A.27, subsection 2, paragraph a, Code
142019, is amended to read as follows:
   15a.  A certificate of completion shall not be issued to
16a person who has not satisfactorily completed an approved
17hunter education course. The department shall establish the
18curriculum based on the standards adopted by the international
19hunter education association — United States of America for
20the approved hunter education course. The curriculum shall
21include instruction relating to becoming an organ donor under
22the revised uniform anatomical gift Act as provided in chapter
23142C.
Upon completion of the course, each person shall pass
24an individual oral test or a written test provided by the
25department. The department shall establish the criteria for
26successfully passing the tests. Based on the results of
27the test and demonstrated safe handling of a firearm, the
28instructor shall determine the persons who shall be issued a
29certificate of completion.
