3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  455F.8C  Household hazardous plants
2— label requirements.
   31.  For purposes of this section:
   4a.  “Household hazardous plant” means a plant or plant
5product, designated by rule of the department of natural
6resources, which is used for residential purposes and which
7may produce personal injury or illness to humans or animals if
8ingested or consumed.
   9b.  “Label” means a written, printed, or graphic notice or
10statement on the immediate container of a household hazardous
11plant.
   122.  A person shall not distribute, sell, or offer for
13retail sale in the state a household hazardous plant unless
14the plant bears a label containing a warning or caution
15statement prominently displayed thereon, in accordance with
16rules prescribed by the department, identifying the plant as a
17hazardous household plant which may produce injury or illness
18if ingested or consumed.
19EXPLANATION
20The inclusion of this explanation does not constitute agreement with
21the explanation’s substance by the members of the general assembly.
   22This bill prohibits a person from distributing, selling, or
23offering for retail sale in the state a household hazardous
24plant unless the plant bears a label containing a prominent
25warning or caution statement, in accordance with rules
26prescribed by the department of natural resources identifying
27the plant as a hazardous household plant which may produce
28injury or illness if ingested or consumed. The bill defines
29“household hazardous plant” to mean a plant or plant product,
30designated by the department, which is used for residential
31purposes and which may produce personal injury or illness to
32humans or animals if ingested or consumed.
   33Pursuant to Code section 455F.10, a person who violates the
34bill is guilty of a simple misdemeanor. A simple misdemeanor
35is punishable by confinement for no more than 30 days or a fine
