House Study Bill 174 - IntroducedA Bill ForAn Act 1relating to debts for which the homestead is liable by
2providing that the homestead may be sold to satisfy debts
3secured by a mechanic’s lien, including principal, interest,
4attorney fees, and costs.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 561.21, subsection 3, Code 2019, is
2amended to read as follows:
   33.  Those incurred secured by a mechanic’s lien under
4chapter 572, including principal, interest, attorney fees, and
5costs,
for work done or material furnished exclusively for the
6improvement of the homestead.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
   10This bill relates to debts for which the homestead is liable.
11Current law provides that the homestead may be sold to satisfy
12debts incurred for work done or material furnished exclusively
13for the improvement of the homestead. The bill provides
14that the homestead may be sold to satisfy debts secured by
15a mechanic’s lien under chapter 572, including principal,
16interest, attorney fees, and costs, for work done or materials
17furnished to improve the homestead.
