3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 309.57, subsection 5, Code 2019, is
2amended to read as follows:
   35.  A road with an area service “C” classification shall
4retain the classification until such time as a petition for
5reclassification is submitted to the board of supervisors.
6The petition shall be signed by one or more all adjoining
7landowners. The board of supervisors shall approve or deny the
8request for reclassification within sixty days of receipt of
9the petition.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13Under current law, a county board of supervisors, after
14consultation with the county engineer, and for purposes
15of specifying levels of maintenance effort and access, may
16classify an area service system into three classifications
17termed area service “A”, area service “B”, and area service
18“C”. Area service “C” classification roads may have restricted
19access and a minimal level of maintenance as specified by the
20county board of supervisors after consultation with the county
21engineer. A road with an area service “C” classification
22retains the classification until such time as a petition
23for reclassification is submitted to the county board of
24supervisors. The petition must be signed by one or more
25adjoining landowners. This bill requires the petition to be
26signed by all adjoining landowners.
