4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 8D.8, Code 2019, is amended to read as
2follows:
   38D.8  Scheduling for authorized users.
   4Except as provided in section 8D.5, an An authorized user
5is responsible for all scheduling of the use of the authorized
6user’s facility. A person who disputes a scheduling decision
7of such user may petition the commission for a review of such
8decision pursuant to section 8D.3, subsection 3, paragraph “c”.
9   Sec. 2.  Section 8D.13, subsection 8, Code 2019, is amended
10by striking the subsection.
11   Sec. 3.  REPEAL.  Section 8D.5, Code 2019, is repealed.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
   15This bill strikes Code section 8D.5, which establishes
16the education telecommunications council and regional
17telecommunications councils under the Iowa communications
18network (ICN). Code section 8D.5 provides that the 18-member
19education telecommunications council is responsible for
20scheduling and site usage policies for educational users of the
21ICN, coordinating the activities of regional telecommunications
22councils, developing proposed rules and changes to rules for
23recommendation to the Iowa telecommunications and technology
24commission, and recommending long-range plans for enhancements
25needed for educational applications. Code section 8D.5 also
26provides that regional telecommunications councils, established
27in each merged area as provided in Code chapter 260C, are
28responsible for advising the education telecommunications
29council on the assessment of local educational needs and
30the coordination of program activities. The bill removes
31references to the education telecommunications council and
32regional telecommunications councils from Code chapter 8D.
