3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 633A.4604, subsection 2, Code 2019, is
2amended to read as follows:
   32.  The certification of trust must contain a statement do
4all of the following:

   5a.   Statethat the trust has not been revoked, modified,
6or amended in any manner which that would cause the
7representations contained in the certification of trust to be
8incorrect and must contain a statement that it is being.
   9b.   Besigned by all of the a currently acting trustees of
10the trust and is sworn and
 trustee or the attorney of an acting
11trustee.

   12c.   Besubscribed and sworn to under penalty of perjury
13before a notary public as provided in chapter 9B.
14   Sec. 2.  APPLICABILITY.  This Act applies to certifications
15of trust signed on and after July 1, 2019.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill relates to the requirements for a certification
20of trust. Under current law, the certification of trust must
21contain a statement that it is being signed by all of the
22currently acting trustees of the trust. Under the bill, the
23certification of trust must be signed by an acting trustee
24or the attorney for an acting trustee. The bill applies to
25certifications of trust signed on and after July 1, 2019.
