3displaying licenses and tags for hunting and fishing.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 483A.6A, subsection 3, Code 2019, is
2amended to read as follows:
   33.  The commission shall establish the number of annual
4paddlefish fishing licenses that may be issued pursuant to
5section 481A.39 for use on the Missouri or Big Sioux river.
6A paddlefish fishing license shall be accompanied by a tag
7designed to be used only once. If a paddlefish is taken
8pursuant to a paddlefish fishing license, the paddlefish
9shall be tagged immediately, or an electronic tag established
10pursuant to section 483A.18A shall be filled immediately,
and
11the tag shall be dated.
12   Sec. 2.  Section 483A.7, subsection 2, Code 2019, is amended
13to read as follows:
   142.  The wild turkey hunting license shall be accompanied
15by a tag designed to be used only once. If a wild turkey
16is taken, the wild turkey shall be tagged, or an electronic
17tag established pursuant to section 483A.18A shall be filled
18immediately,
and the tag shall be dated.
19   Sec. 3.  Section 483A.8, subsection 2, Code 2019, is amended
20by adding the following new paragraph:
21   NEW PARAGRAPH.  c.  Notwithstanding paragraphs “a” and “b”,
22a person hunting deer who has purchased a deer hunting license
23and tag through a mobile application pursuant to section
24483A.18A shall immediately fill an electronic tag except as
25provided in section 483A.18A, subsection 2.
26   Sec. 4.  Section 483A.18, Code 2019, is amended to read as
27follows:
   28483A.18  Form of licenses.
   29All hunting, fishing, and fur harvester licenses shall
30contain a general description of the licensee. Such licenses
31shall be upon such forms as the commission shall adopt. The
32address and the signature of the applicant and all signatures
33and other required information shall be in writing except as
34provided in section 483A.18A
. All licenses shall clearly
35indicate the nature of the privilege granted.

1   Sec. 5.  NEW SECTION.  483A.18A  Mobile application to
2purchase and display a permit, license, or tag — rules.
   31.  The department shall develop and make available for use
4a mobile application on which a person may purchase any permit,
5license, or tag issued pursuant to this chapter. Permits,
6licenses, and tags carried in an electronic format shall
7display either a digitized image of a handwritten signature or
8some other form of an electronic signature.
   92.  A physical tag is required if a hunter who takes a wild
10turkey or deer leaves the immediate presence of the harvested
11wild turkey or deer.
   123.  The department shall adopt rules pursuant to chapter 17A
13to implement this section.
14   Sec. 6.  Section 483A.19, Code 2019, is amended to read as
15follows:
   16483A.19  Showing license document to officer.
   171.  Every person shall, while fishing, hunting, or fur
18harvesting, show the person’s license document to any peace
19officer or the owner or person in lawful control of the land
20or water upon which licensee may be hunting, fishing, or
21fur harvesting when requested by the persons to do so. Any
22failure to so carry or refusal to show or so exhibit the
23person’s license document shall be a violation of this chapter.
24However, except for possession and exhibition of deer licenses
25and tags or wild turkey licenses and tags, a person charged
26with violating this section shall not be convicted if the
27person produces in court, within a reasonable time, a license
28document for hunting, fishing, or fur harvesting issued to that
29person and valid when the person was charged with a violation
30of this section.
   312.  Display of a permit, license, or tag purchased pursuant
32to section 483A.18A on a cellular telephone or other electronic
33mobile or portable device shall satisfy the requirements of
34subsection 1 of this section.
35   Sec. 7.  Section 483A.24, subsection 7, Code 2019, is amended
-2-1to read as follows:
   27.  A license shall not be required of minor pupils of the
3state school for the blind, state school for the deaf, or of
4minor residents of other state institutions under the control
5of an administrator of a division of the department of human
6services. In addition, a person who is on active duty with the
7armed forces of the United States, on authorized leave from
8a duty station located outside of this state, and a resident
9of the state of Iowa shall not be required to have a license
10to hunt or fish in this state. The military person shall
11carry the person’s leave papers and a copy of the person’s
12current earnings statement showing a deduction for Iowa income
13taxes while hunting or fishing. In lieu of carrying the
14person’s earnings statement, the military person may also claim
15residency if the person is registered to vote in this state.
16If a deer or wild turkey is taken, the military person shall
17immediately contact a state conservation officer or use the
18mobile application developed pursuant to section 483A.18A
to
19obtain an appropriate tag to transport the animal. A license
20shall not be required of residents of county care facilities
21or any person who is receiving supplementary assistance under
22chapter 249.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26This bill directs the department of natural resources to
27develop and offer for use a mobile application on which a
28person may purchase permits, licenses, and tags for hunting
29and fishing. A permit, license, or fee purchased through the
30mobile application shall display either a digitized image
31of a handwritten signature or some other form of electronic
32signature. The bill requires a person to physically tag
33a harvested wild turkey or deer if the person leaves the
34immediate presence of the harvested wild turkey or deer. When
35required to show a license document to a peace officer or
-3-1person in lawful control of the land or water upon which a
2licensee may be hunting, fishing, or fur harvesting, the hunter
3may display a permit, license, or tag purchased through the
4mobile application on a cellular telephone or other electronic
5mobile or portable device.
   6The bill requires the department to adopt rules to regulate
7the use of the mobile application.
