Senate Study Bill 1111 - IntroducedA Bill ForAn Act 1providing for the sale of certain mushrooms at farmers
2markets, and providing an effective date.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 137F.2, Code 2019, is amended to read as
2follows:
   3137F.2  Adoption by rule.
   41.  The department shall, in accordance with chapter 17A,
5adopt rules setting minimum standards for entities covered
6under this chapter to protect consumers from foodborne
7illness. In so doing, the department may adopt by reference,
8with or without amendment, the United States food and drug
9administration food code, which shall be specified by title
10and edition, date of publication, or similar information. The
11rules and standards shall be formulated in consultation with
12municipal corporations under agreement with the department,
13affected state agencies, and industry, professional, and
14consumer groups.
   152.  In establishing minimum standards as described in
16subsection 1, the department shall adopt rules for the sale at
17a farmers market of culinary mushrooms commonly referred to as
18a variety of wild golden oyster and classified as pleurotus
19ostreatus, pleurotus populinus, or pleuotus pulmonarious.
20   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
21importance, takes effect upon enactment.
22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25This bill provides for the sale of wild golden oyster
26mushrooms at farmers markets according to rules adopted by the
27department of inspections and appeals. The department has
28adopted the United States food and drug administration food
29code subject to certain exceptions (e.g., morel mushrooms).

   31The bill takes effect upon enactment.
