House Study Bill 103 - IntroducedA Bill ForAn Act 1relating to matters under the purview of the Iowa
2lottery authority, including authorization to conduct sports
3betting as a lottery game and providing criminal penalties.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 99G.3, subsection 7, Code 2019, is
2amended to read as follows:
   37.  “Lottery”, “lotteries”, “lottery game”, “lottery games”,
4or “lottery products” means any game of skill or chance approved
5by the board and operated pursuant to this chapter, including
6but not limited to sports betting,
and games using mechanical
7or electronic devices, provided that the authority shall not
8authorize a monitor vending machine or a player-activated
9gaming machine that utilizes an internal randomizer to
10determine winning and nonwinning plays and that upon random
11internal selection of a winning play dispenses coins, currency,
12or a ticket, credit, or token to the player that is redeemable
13for cash or a prize, and excluding gambling or gaming conducted
14pursuant to chapter 99B, 99D, or 99F.
15   Sec. 2.  Section 99G.3, Code 2019, is amended by adding the
16following new subsection:
17   NEW SUBSECTION.  16A.  “Sports betting” means the acceptance
18of wagers on collegiate or professional sporting events by any
19system of wagering as authorized by the board and conducted
20pursuant to this chapter.
21   Sec. 3.  Section 99G.9, subsection 3, paragraph b, Code 2019,
22is amended to read as follows:
   23b.  The sale price of tickets or shares and the manner
24of sale, including but not limited to authorization of sale
25of tickets or shares at a discount for marketing purposes;
26provided, however, that a retailer may accept payment by
27cash, check, money order, debit card, or prepaid gift card,
28nondeferred electronic payments through electronic wallets or
29mobile applications,
electronic funds transfer and, or other
30form of cash-based payment, so long as it
shall not extend or
31arrange credit for the purchase of a ticket or share. As used
32in this section, “cash” means United States currency.
33   Sec. 4.  Section 99G.36, Code 2019, is amended by adding the
34following new subsection:
35   NEW SUBSECTION.  2A.  Any person who influences or attempts
-1-1to influence the outcome of a sporting contest where a sports
2betting wager was placed pursuant to this chapter shall be
3guilty of a class “D” felony.
4EXPLANATION
5The inclusion of this explanation does not constitute agreement with
6the explanation’s substance by the members of the general assembly.
   7This bill concerns the Iowa lottery authority.
   8Code section 99G.3, definitions, is amended. The definition
9of “lottery” is amended to authorize any game of skill approved
10by the board of directors of the Iowa lottery authority and to
11also authorize sports betting. “Sports betting” is defined as
12the acceptance of wagers on collegiate or professional sporting
13events.
   14Code section 99G.9, concerning lottery board of directors’
15duties and specifically the authority to adopt administrative
16rules, is amended. The bill authorizes the board to adopt
17rules allowing a retailer to also accept payment for a lottery
18ticket or share by prepaid gift card, nondeferred electronic
19payments through electronic wallets or mobile applications,
20or other form of cash-based payment, so long as the retailer
21does not extend or arrange for credit to purchase the ticket or
22share.
   23Code section 99G.36, concerning criminal penalties, is
24amended to provide that a person who influences or attempts
25to influence the outcome of a sporting contest where a sports
26betting wager was placed shall be guilty of a class “D” felony.
27A class “D” felony is punishable by confinement for no more
28than five years and a fine of at least $750 but not more than
29$7,500.
