Senate Study Bill 1083 - IntroducedA Bill ForAn Act 1relating to the enhance Iowa board and moneys allocated

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 15F.102, subsection 3, paragraph c, Code
22019, is amended to read as follows:
   3c.  The members appointed pursuant to subsection 2 shall
4be appointed to two-year three-year staggered terms and the
5terms shall commence and end as provided by section 69.19. If
6a vacancy occurs, a successor shall be appointed to serve the
7unexpired term. A successor shall be appointed in the same
8manner and subject to the same qualifications as the original
9appointment to serve the unexpired term.
10   Sec. 2.  Section 15F.104, Code 2019, is amended to read as
11follows:
   1215F.104  Authority duties.
   13The authority, subject to approval by the board, shall adopt
14administrative rules pursuant to chapter 17A necessary to
15administer the programs established pursuant to this chapter.
16The authority shall provide the board with assistance in
17implementing administrative functions, marketing the programs,
18providing technical assistance and application assistance
19to applicants under the programs, negotiating contracts,
20and providing project follow-up. The authority may conduct
21negotiations on behalf of the board with applicants regarding
22terms and conditions applicable to awards under the programs.
23   Sec. 3.  Section 15F.204, subsection 5, unnumbered paragraph
241, Code 2019, is amended to read as follows:
   25At the beginning of each fiscal year, the board shall
26allocate one hundred thousand dollars for purposes of marketing
27those projects that are receiving moneys from the fund. After

30   Sec. 4.  Section 15F.401, subsection 9, Code 2019, is amended
31to read as follows:
   329.  The authority, with the approval of the board, shall
33adopt rules for the administration of this subchapter.
34   Sec. 5.  TRANSITION — APPOINTMENT AND TERM OF ENHANCE IOWA
35BOARD MEMBERS.
  This Act shall not affect the appointment or
-1-1term of a member serving on the enhance Iowa board immediately
2prior to the effective date of this Act. For terms beginning
3May 1, 2019, four members shall be appointed to a three-year
4term and one member shall be appointed to a two-year term. For
5terms beginning May 1, 2020, four members shall be appointed
6to a three-year term and two members shall be appointed to a
7one-year term. For a term beginning May 1, 2021, or after, all
8members shall be appointed to a three-year term.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to the enhance Iowa board.
   13The bill increases the term of voting members on the board
14from two to three years. The bill provides for a transition
15from the current two-year staggered terms to three-year
16staggered terms.
   17The bill directs the board, rather than the economic
18development authority, to adopt rules to administer the
19programs established in Code chapter 15F.
   20The bill eliminates the requirement that the board, at the
21beginning of each fiscal year, allocate $100,000 from the
22community attraction and tourism fund to market projects that
23are receiving moneys from the fund.
