2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  279.72  Food options offered by
2school districts.
   31.  By the school year beginning July 1, 2022, and each
4succeeding school year, not less than one hundred percent of
5the foods sold or provided by a school district on school
6grounds during the school day, including but not limited to a
7school breakfast or lunch program operated in accordance with
8the provisions of chapter 283A, shall be certified organic
9by the department of agriculture and land stewardship under
10chapter 190C or by a certifying agent authorized or certified
11by the United States department of agriculture under the
12national organic program as defined in section 190C.1.
   132.  By the school year beginning July 1, 2019, and each
14succeeding school year, a school district providing a school
15breakfast or lunch program operated in accordance with the
16provisions of chapter 283A shall offer a daily vegetarian
17entree option for each meal served under the program.
   183.  By the school year beginning July 1, 2019, and each
19succeeding school year prior to the school year beginning
20July 1, 2022, not less than fifty percent of the foods sold
21or provided by a school district on school grounds during the
22school day, including but not limited to a school breakfast or
23lunch program operated in accordance with the provisions of
24chapter 283A, shall be certified organic by the department of
25agriculture and land stewardship under chapter 190C or by a
26certifying agent authorized or certified by the United States
27department of agriculture under the national organic program as
28defined in section 190C.1. This subsection is repealed July
291, 2022.
30   Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
31with section 25B.2, subsection 3, the state cost of requiring
32compliance with any state mandate included in this Act shall
33be paid by a school district from state school foundation aid
34received by the school district under section 257.16. This
35specification of the payment of the state cost shall be deemed
-1-1to meet all of the state funding-related requirements of
2section 25B.2, subsection 3, and no additional state funding
3shall be necessary for the full implementation of this Act
4by and enforcement of this Act against all affected school
5districts.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9This bill requires each school district to offer a daily
10vegetarian entree option under the school breakfast and lunch
11programs operated by the school district; requires by July
121, 2019, that 50 percent of the food sold or provided by the
13school district on school grounds be certified organic; and,
14by July 1, 2022, that 100 percent of such food be certified
15organic.
   16The bill repeals the provision that requires 50 percent of
17the foods sold or provided by the school district be certified
18organic on July 1, 2022, the date the 100 percent requirement
19takes effect.
   20The bill may include a state mandate as defined in Code
21section 25B.3. The bill requires that the state cost of
22any state mandate included in the bill be paid by a school
23district from state school foundation aid received by the
24school district under Code section 257.16. The specification
25is deemed to constitute state compliance with any state mandate
26funding-related requirements of Code section 25B.2. The
27inclusion of this specification is intended to reinstate the
28requirement of political subdivisions to comply with any state
29mandates included in the bill.
