House Study Bill 91 - IntroducedA Bill ForAn Act 1relating to community catalyst building remediation
2grants for emergency projects.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 15.231, subsection 2, Code 2019, is
2amended to read as follows:
   32.  a.  The authority shall use moneys in the fund to
4provide grants to cities for the remediation of underutilized
5buildings. The authority may provide grants under this
6section using a competitive scoring process. Notwithstanding
7subsection 3, an emergency project shall be eligible for a
8grant under this section.

   9b.  As used in this section, unless the context otherwise
10requires:
   11(1)  “Emergency project” means remediation of an
12underutilized building that may present a unique and immediate
13opportunity, or a unique and immediate threat.
   14(2)  “Unique and immediate opportunity” means remediation of
15an underutilized building is time-sensitive and remediation is
16reasonably expected to result in economic growth for the city
17in which the underutilized building is located.
   18(3)  “Unique and immediate threat” means remediation of an
19underutilized building may involve an unforeseen challenge or
20problem that has the potential to result in a catastrophic
21failure of the building’s integrity and structural system.
22An unforeseen challenge or problem may include an act of
23nature such as a fire, flood, or storm, or an unexpected
24structural deficiency such as a compromised load-bearing
25wall. A challenge or problem caused by deferred maintenance
26on the underutilized building does not qualify as a unique and
27immediate threat.
28EXPLANATION
29The inclusion of this explanation does not constitute agreement with
30the explanation’s substance by the members of the general assembly.
   31Under the community catalyst building remediation
32program, this bill allows an emergency project to be eligible
33for a grant. “Emergency project” is a remediation of an
34underutilized building that may present a unique and immediate
35opportunity, or a unique and immediate threat. A unique and

2expected to result in economic growth. A unique and immediate
3threat is a remediation that may involve unforeseen challenges
4or problems.
