3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 8A.432, subsection 1, Code 2019, is
2amended to read as follows:
   31.  The department shall establish and administer a combined
4charitable campaign program for state employees pursuant to
5the requirements set forth in sections 70A.14 and 70A.15
.
 6Administration of the combined charitable campaign program
7shall include allowing equal access to state officers and
8employees by each charitable organization that desires to
9participate in the charitable campaign program. Such access
10shall include but is not limited to distributing materials,
11making presentations, participating in kick-off and other
12charitable campaign program events, and allowing media coverage
13of the campaign.

14   Sec. 2.  Section 70A.14, subsection 1, Code 2019, is amended
15to read as follows:
   161.  “Charitable organization” means an organization that is
17eligible to receive contributions which may be deducted on the
18contributor’s Iowa individual tax return and that has been
19designated, at the request of one hundred or more eligible
20state officers and employees, or the number of employees
21required by subsection 3 of this section,
by a responsible
22official of the payroll system under which the officers or
23employees are compensated, to receive contributions pursuant
24to section 70A.15.
25   Sec. 3.  Section 70A.14, subsection 3, Code 2019, is amended
26by striking the subsection.
27   Sec. 4.  Section 70A.15A, Code 2019, is amended by adding the
28following new subsection:
29   NEW SUBSECTION.  1A.  An applicable public employer that
30authorizes deductions from the salaries or wages of its
31employees for payment to an eligible charitable organization
32shall establish and administer a combined charitable campaign
33program. Administration of the combined charitable campaign
34program shall include allowing equal access to employees of
35the applicable public employer by each eligible charitable
-1-1organization that desires to participate in the charitable
2campaign program. Such access shall include but is not limited
3to distributing materials, making presentations, participation
4in kick-off and other charitable campaign program events, and
5allowing media coverage of the campaign.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9This bill requires certain public employers that provide
10payroll deductions from their employees’ wages for payment to
11a charitable organization to administer a combined charitable
12campaign program that includes all eligible charitable
13organizations that wish to participate. The requirements
14apply to a state officer or employer, a board of directors
15of a school district, a community college, a county board of
16supervisors, or a governing body of a city.
   17The combined charitable campaign program must allow equal
18access to employees of the state officer or other public
19employer by each eligible charitable organization that desires
20to participate in the charitable campaign program; such access
21shall include but is not limited to distributing materials,
22making presentations, participation in kick-off and other
23charitable campaign program events, and allowing media coverage
24of the campaign.
   25The bill also eliminates requirements that a charitable
26organization can participate in the combined charitable
27campaign program for state officers or employees only if a
28specified number of state officers or employees has chosen that
29organization to receive contributions.
