4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 260C.14, Code 2019, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  25.  Adopt a policy, to take effect
4not later than January 1, 2020, relating to an additional
5classification of students, for purposes of determining tuition
6and fees, to grant resident status to individuals who meet all
7of the following conditions:
   8a.  Attended an accredited school in this state for at least
9five years as of the date the individual graduated from an
10accredited high school or received a high school equivalency
11diploma in this state.
   12b.  Is accepted for enrollment by the community college.
   13c.  Was not required to pay tuition to attend a public high
14school in this state.
   15d.  Signs an affidavit, if the individual does not have a
16social security number, stating that the individual will pursue
17citizenship in the United States at the earliest possible time
18the individual is able to do so.
19   Sec. 2.  Section 262.9, Code 2019, is amended by adding the
20following new subsection:
21   NEW SUBSECTION.  39.  Adopt a policy, to take effect
22not later than January 1, 2020, relating to an additional
23classification of students, for purposes of determining tuition
24and fees, to grant resident status to individuals who meet all
25of the following conditions:
   26a.  Attended an accredited school in this state for at least
27five years as of the date the individual graduated from an
28accredited high school or received a high school equivalency
29diploma in this state.
   30b.  Is accepted for enrollment by a university under the
31control of the board.
   32c.  Was not required to pay tuition to attend a public high
33school in this state.
   34d.  Signs an affidavit, if the individual does not have a
35social security number, stating that the individual will pursue
-1-1citizenship in the United States at the earliest possible time
2the individual is able to do so.
3EXPLANATION
4The inclusion of this explanation does not constitute agreement with
5the explanation’s substance by the members of the general assembly.
   6This bill directs the board of directors of a community
7college and the state board of regents to adopt policies
8that take effect not later than January 1, 2020, relating to
9an additional classification of students, for purposes of
10determining tuition and fees, to grant resident status to
11certain individuals.
   12To meet the requirements of the policy, an individual must
13have attended an accredited school in this state for at least
14five years prior to graduating from high school, or received a
15high school equivalency diploma in this state; be accepted for
16enrollment by a public postsecondary institution in this state;
17must not have been required to pay tuition to attend a public
18high school in this state; and must sign an affidavit, if the
19individual does not have a social security number, stating that
20the individual will pursue U.S. citizenship at the earliest
21possible time the individual is able to do so.
