2anatomical donor symbols on certain licenses.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 142C.2, subsection 6, Code 2019, is
2amended to read as follows:
   36.  “Document of gift” means a donor card or other record
4used to make an anatomical gift, including a statement or
5symbol on a driver’s license, or identification card, or
6hunting, fishing, or fur harvester license,
or an entry in a
7donor registry.
8   Sec. 2.  Section 142C.2, Code 2019, is amended by adding the
9following new subsection:
10   NEW SUBSECTION.  13A.  “Hunting, fishing, or fur harvester
11license”
means a license issued by the department of natural
12resources or an authorized license agent pursuant to chapter
13483A.
14   Sec. 3.  Section 142C.3, subsection 1, paragraph a, Code
152019, is amended by adding the following new subparagraph:
16   NEW SUBPARAGRAPH.  (4)  A minor, if the minor is authorized
17under state law to apply for a hunting, fishing, or fur
18harvester license, the minor is at least 14 years of age, and
19the minor authorizes a symbol indicating an anatomical gift on
20a hunting, fishing, or fur harvester license with the signed
21approval of a parent or guardian.
22   Sec. 4.  Section 142C.3, subsection 2, paragraph a, Code
232019, is amended by adding the following new subparagraph:
24   NEW SUBPARAGRAPH.  (02)  By authorizing a symbol indicating
25that the donor has made an anatomical gift to be imprinted on
26the donor’s hunting, fishing, or fur harvester license.
27   Sec. 5.  Section 142C.3, subsection 2, paragraph c, Code
282019, is amended to read as follows:
   29c.  Revocation, suspension, expiration, or cancellation of a
30driver’s license, or identification card, or hunting, fishing,
31or fur harvester license
upon which an anatomical gift is
32indicated shall not invalidate the gift.
33   Sec. 6.  Section 142C.8, subsections 1 and 2, Code 2019, are
34amended to read as follows:
   351.  When a hospital refers an individual at or near death
-1-1to a procurement organization, the procurement organization
2shall make a reasonable search of the records of the state
3department of transportation, department of natural resources,
4 and any donor registry that the hospital knows exists for the
5geographical area in which the individual resides to ascertain
6whether the individual has made an anatomical gift.
   72.  A procurement organization shall be allowed reasonable
8access to information in the records of the state department
9of transportation and the department of natural resources to
10ascertain whether an individual at or near death is a donor.
11   Sec. 7.  Section 142C.18, Code 2019, is amended by adding the
12following new subsection:
13   NEW SUBSECTION.  2A.  The department of natural resources
14shall cooperate with a person that administers the Iowa donor
15registry for the purpose of transferring to the donor registry
16all relevant information regarding a donor’s making of an
17anatomical gift.
18   Sec. 8.  Section 142C.18, subsection 3, paragraph d, Code
192019, is amended to read as follows:
   20d.  Provide a centralized, automated system to compile
21donation information received by the state department of
22transportation, department of natural resources, county
23treasurers, and the Iowa donor network.
24   Sec. 9.  Section 483A.10, Code 2019, is amended by adding the
25following new subsection:
26   NEW SUBSECTION.  3.  An application for a hunting, fishing,
27or fur harvester license shall include a section where an
28applicant may request that the applicant’s license include a
29symbol that indicates that the applicant is a donor under the
30revised uniform anatomical gift Act as provided in chapter
31142C.
32   Sec. 10.  Section 483A.18, Code 2019, is amended to read as
33follows:
   34483A.18  Form of licenses.
   351.  All hunting, fishing, and fur harvester licenses shall
-2-1contain a general description of the licensee. Such licenses
2shall be upon such forms as the commission shall adopt. The
3address and the signature of the applicant and all signatures
4and other required information shall be in writing. All
5licenses shall clearly indicate the nature of the privilege
6granted.
   72.  Upon request of an applicant pursuant to section 483A.10,
8the department shall indicate on the license that the applicant
9is a donor under the revised uniform anatomical gift Act as
10provided in chapter 142C.
11   Sec. 11.  Section 483A.27, subsection 2, paragraph a, Code
122019, is amended to read as follows:
   13a.  A certificate of completion shall not be issued to
14a person who has not satisfactorily completed an approved
15hunter education course. The department shall establish the
16curriculum based on the standards adopted by the international
17hunter education association — United States of America for
18the approved hunter education course. The curriculum shall
19include instruction relating to becoming an organ donor under
20the revised uniform anatomical gift Act as provided in chapter
21142C.
Upon completion of the course, each person shall pass
22an individual oral test or a written test provided by the
23department. The department shall establish the criteria for
24successfully passing the tests. Based on the results of
25the test and demonstrated safe handling of a firearm, the
26instructor shall determine the persons who shall be issued a
27certificate of completion.
28EXPLANATION
29The inclusion of this explanation does not constitute agreement with
30the explanation’s substance by the members of the general assembly.
   31Current law does not require the department of natural
32resources to include on a hunting, fishing, or fur harvester
33license application a section where an applicant may request
34that the applicant’s license indicate that the applicant is
35a donor under the revised uniform anatomical gift Act. This
-3-1bill requires the department to include such a section. If
2any adult applicant or any minor applicant who is at least
314 years of age and has the signed approval of a parent or
4guardian requests that the applicant’s hunting, fishing, or
5fur harvester license indicate that the applicant is a donor
6under the revised uniform anatomical gift Act, the department
7must place a symbol on the applicant’s license that makes the
8indication. An applicant’s authorization to have the symbol
9placed on the applicant’s hunting, fishing, or fur harvester
10license is a valid method of making an anatomical gift under
11the bill.
   12The bill requires the department to provide reasonable
13access to information to a procurement organization to
14ascertain whether an individual at or near death is a donor.
15The bill also requires the department to cooperate with a
16person that administers the Iowa donor registry for the purpose
17of transferring to the registry all relevant information
18regarding a donor’s making of an anatomical gift. The
19department shall also include instruction relating to becoming
20an organ donor under the revised uniform anatomical gift Act in
21its hunter education program curriculum.
