2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 235F.1, subsection 17, Code 2019, is
2amended to read as follows:
   317.  “Vulnerable elder” means a person sixty years of age or
4older who is unable to protect himself or herself from elder
5abuse as a result of age or and a mental or physical condition.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9Currently, under Code section 235F.1(17), “vulnerable elder”
10is defined as a person 60 years of age or older who is unable to
11protect himself or herself from elder abuse either as a result
12of the person’s age or as a result of the person’s mental or
13physical condition. This bill modifies this definition to
14provide that a “vulnerable elder” is a person 60 years of age
15or older who is unable to protect himself or herself from
16elder abuse as a result of both the person’s age and mental or
17physical condition.
