3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  455B.702  Crude oil disaster
2prevention and response fee.
   31.  A crude oil disaster prevention and response fee shall
4be payable by the owner or operator of a pipeline company, as
5defined in section 479B.2, in an amount equal to twenty-four
6ten-thousandths of one cent per gallon of crude oil transported
7out of the state by pipeline, whether extracted in or out of
8the state. The director shall establish by rule procedures for
9collection of the fees.
   102.  Fees collected pursuant to this section shall be
11deposited as follows:
   12a.  Fifty percent shall be deposited in the water quality
13infrastructure fund in section 8.57B.
   14b.  Fifty percent shall be deposited in the water quality
15financial assistance fund in section 16.134A.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill creates a crude oil disaster prevention and
20response fee applied to crude oil transported out of the state
21by pipeline and payable by the owner or operator of a pipeline
22company. The bill requires the director of the department of
23natural resources to establish rules for collecting the fee.
24Fifty percent of the fees collected shall be deposited in the
25water quality infrastructure fund and the other 50 percent of
26the fees collected shall be deposited in the water quality
27financial assistance fund.
