House Study Bill 1 - IntroducedA Bill ForAn Act 1relating to the practice of massage therapy, and
2providing penalties.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 152C.5, Code 2019, is amended to read as
2follows:
   3152C.5  Practice or use of title — license required.
   4The practice of massage therapy as defined in section
5152C.1 is strictly prohibited by unlicensed individuals. It
6is unlawful a serious misdemeanor for a person to engage in or
7offer to engage in the practice of massage therapy, or use in
8connection with the person’s name, the initials “L.M.T.” or
9the words “licensed massage therapist”, “massage therapist”,
10“masseur”, “masseuse”, or any other word or title that implies
11or represents that the person practices massage therapy, unless
12the person possesses a license issued under the provisions of
13section 152C.3.
14   Sec. 2.  NEW SECTION.  152C.10  Enforcement.
   15A political subdivision of the state shall not enact or
16enforce any restrictions or requirements concerning massage
17therapists and the practice of massage therapy that are
18inconsistent with the provisions of this chapter.
19EXPLANATION
20The inclusion of this explanation does not constitute agreement with
21the explanation’s substance by the members of the general assembly.
   22This bill makes the practice of massage therapy or the use
23of titles associated with massage therapists by an unlicensed
24individual a serious misdemeanor. A serious misdemeanor is
25punishable by confinement for no more than one year and a fine
26of at least $315 but not more than $1,875. The bill also
27prohibits political subdivisions of the state from enacting or
28enforcing restrictions on massage therapy or massage therapists
29that are not contained in Code chapter 152C.
