3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  256.9B  School board petition to
2amend or repeal administrative rule.
   3If the board of directors of a school district submits to
4the department, in accordance with section 17A.7, a petition
5to amend or repeal a rule adopted by the state board, and the
6department finds no statutory authority supporting the rule,
7finds the rule is inconsistent or incompatible with statute, or
8finds that the state board exceeded its authority in adopting
9all or part of the rule, the state board shall repeal the
10rule from the Iowa administrative code or amend the rule as
11necessary to comply with statute.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
   15This bill provides that if the board of directors of a school
16district submits a petition to the department of education to
17amend or repeal a rule adopted by the state board of education,
18as authorized under Code chapter 17A, and the department
19finds no statutory authority for the rule, finds the rule is
20inconsistent or incompatible with statute, or finds that the
21state board exceeded its authority in adopting all or part of
22the rule, the state board must repeal the rule or amend the
23rule as necessary to comply with statute.
