Senate Study Bill 1019 - IntroducedA Bill ForAn Act 1relating to stocking of waters located on private

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 481A.78, Code 2019, is amended by
2striking the section and inserting in lieu thereof the
3following:
4481A.78 Stocking private water.
5The commission shall not stock a private pond or lake.
6However, the commission may stock a creek or stream flowing
7through private property.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11Under current law, the natural resource commission may stock
12private water only when the owner of the private water agrees
13that such water shall be open to the public for fishing. The
14commission may provide a breeding stock of fish for privately
15owned farm ponds upon the request of the owner.
16This bill prohibits the commission from stocking a private
17lake or pond. The commission may, however, stock a creek or
18stream that flows through private property.
