Section
1.
Section
280.13,
Code
2025,
is
amended
to
read
as
1
follows:

280.13
Requirements
for
interscholastic
athletic
contests
and

competitions.

1.
A
public
school
shall
not
participate
in
or
allow
5
students
representing
a
public
school
to
participate
in
any
6
extracurricular
interscholastic
athletic
contest
or
competition
7
which
is
sponsored
or
administered
by
an
organization
as
8
defined
in
this
section
,
unless
the
organization
is
registered
9
with
the
department
of
education,
files
financial
statements
10
with
the
department
in
the
form
and
at
the
intervals
prescribed
11
by
the
director
of
the
department
of
education,
and
is
in
12
compliance
with
rules
which
the
state
board
of
education
adopts
13
for
the
proper
administration,
supervision,
operation,
adoption
14
of
eligibility
requirements,
and
scheduling
of
extracurricular
15
interscholastic
athletic
contests
and
competitions
and
the
16
organizations.

2.
a.
For
the
purposes
of
this
section
“organization”
means
18
a
corporation,
association,
or
organization
to
which
all
of
the
19
following
apply:
20
(1)
The
corporation,
association,
or
organization
has
as
21
one
of
its
primary
purposes
the
sponsoring
or
administration
22
of
extracurricular
interscholastic
athletic
contests
or
23
competitions
,
but
.

(2)
The
corporation,
association,
or
organization
monitors
25
student
participation
in
extracurricular
interscholastic
26
athletic
contests
or
competitions
pursuant
to
section
280.13D.
27
(3)
The
corporation,
association,
or
organization,
when
28
calculating
a
public
school’s
or
nonpublic
school’s
enrollment
29
to
determine
the
classification
of
an
extracurricular
30
interscholastic
athletic
contest
or
competition
provided
by
the
31
public
school
or
nonpublic
school,
counts
the
enrollment
of
32
another
public
school
or
nonpublic
school
that
allows
students
33
to
participate
in
an
extracurricular
interscholastic
athletic
34
contest
or
competition
that
is
provided
by
the
public
school

as

one-fourth
of
the
enrollment
of
students
in
grades
nine
through

eleven

include
an
agency
of
this
state,

or
private
school
or
school
board,
or
an
athletic

Participation
in

extracurricular
interscholastic
athletic
contests
or
competitions

provided
by
public
schools.

1.
a.
The
board
of
directors
of
a
school
district
shall
12
allow
a
student
who
resides
within
the
school
district
and
13
who
is
enrolled
in
a
nonpublic
school
to
participate
in
any
14
extracurricular
interscholastic
athletic
contest
or
competition
15
that
is
provided
by
the
school
district,
but
that
has
not
been
16
provided
by
the
nonpublic
school
during
the
two
immediately
17
preceding
school
years,
pursuant
to
the
terms
of
an
agreement
18
between
the
board
of
directors
of
the
school
district
and
the
19
authorities
in
charge
of
the
nonpublic
school
that
provides
for
20
the
eligibility
of
the
student.

b.
The
board
of
directors
of
a
school
district
shall
allow
22
a
student
who
resides
within
a
contiguous
school
district
and
23
who
is
enrolled
in
a
nonpublic
school
to
participate
in
any
24
extracurricular
interscholastic
athletic
contest
or
competition
25
that
is
provided
by
the
school
district,
but
that
has
not
been
26
provided
by
the
nonpublic
school
or
by
the
student’s
school
27
district
of
residence
during
the
two
immediately
preceding
28
school
years,
pursuant
to
the
terms
of
an
agreement
between
the
29
board
of
directors
of
the
school
district
and
the
authorities
30
in
charge
of
the
nonpublic
school
that
provides
for
the
31
eligibility
of
the
student.

c.
If
the
board
of
directors
of
a
school
district
has
33
established
a
fee
for
the
cost
of
a
student’s
participation
34
in
an
extracurricular
interscholastic
athletic
contest
or
35

competition,
a
student
who
is
enrolled
in
a
nonpublic
school
1
and
is
participating
in
a
contest
or
competition
at
a
public
2
school
pursuant
to
paragraph
“a”
or
“b”
,
or
the
student’s
parent
3
or
guardian,
shall
be
responsible
for
the
payment
of
such
fee.
4
The
amount
of
such
fee
shall
not
exceed
the
amount
of
the
fee
5
the
board
of
directors
of
the
school
district
has
established
6
for
students
who
are
enrolled
in
the
school
district.

2.
A
student
who
is
enrolled
in
a
nonpublic
school
and
8
is
participating
in
a
contest
or
competition
at
a
public
9
school
pursuant
to
subsection
1,
paragraph
“a”
or
“b”
,
shall
10
participate
under
the
same
conditions
as
a
student
who
is
11
enrolled
in
the
school
district,
including
meeting
the
school
12
district’s
student
code
of
conduct
requirements.

3.
A
student
who
participates
in
an
extracurricular
14
interscholastic
athletic
contest
or
competition
pursuant
15
to
this
section
shall
be
deemed
to
satisfy
the
residence
16
requirements
for
purposes
of
section
256.46.
17
Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
18
importance,
takes
effect
upon
enactment.
