S.F. 577 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 14 a. (1) For deposit in the water quality initiative fund 15 created in section 466B.45 for purposes of supporting the 16 water quality initiative administered by the division of soil 17 conservation and water quality as provided in section 466B.42 , 18 including salaries, support, maintenance, and miscellaneous 19 purposes, notwithstanding section 8.57, subsection 5 , paragraph 20 “c”: 21 FY 2023-2024: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 8,200,000 23 (2) (a) The moneys appropriated in this lettered 24 paragraph shall be used to support demonstration projects in 25 subwatersheds as designated by the department that are part 26 of high-priority watersheds identified by the water resources 27 coordinating council. 28 (b) The moneys appropriated in this lettered paragraph 29 shall be used to support demonstration projects in watersheds 30 generally, including regional watersheds, as designated by the 31 division and high-priority watersheds identified by the water 32 resources coordinating council. 33 (3) In supporting projects in watersheds and subwatersheds 34 as provided in subparagraph (2), all of the following shall 35 -1- SF 577 (2) 90 ec/rh/mb 1/ 18
S.F. 577 apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- SF 577 (2) 90 ec/rh/mb 2/ 18
S.F. 577 agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A . 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated in 21 this lettered paragraph may be used for costs of administration 22 and implementation of the water quality initiative administered 23 by the soil conservation division. 24 b. REVERSION. For purposes of section 8.33, unless 17 specifically provided otherwise, unencumbered or unobligated 18 moneys from an appropriation made in this division of this Act 19 shall not revert but shall remain available for expenditure for 20 the purposes designated until the close of the fiscal year that 21 ends two years after the end of the fiscal year for which the 22 appropriation is made. EFFECTIVE DATE. This division of this Act, being 27 deemed of immediate importance, takes effect upon enactment. 28 DIVISION IV 29 MISCELLANEOUS PROVISIONS 30 Sec. 8. Section 8.57C, subsection 3, paragraph a, 31 subparagraph (3), Code 2023, is amended to read as follows: 32 (3) For the fiscal year beginning July 1, 2023 2024 , and for 33 each subsequent fiscal year thereafter, the sum of seventeen 34 million five hundred thousand dollars. 35 -14- SF 577 (2) 90 ec/rh/mb 14/ 18
S.F. 577 Sec. 9. Section 8.57C, subsection 3, Code 2023, is amended 1 by adding the following new paragraph: 2 NEW PARAGRAPH . k. There is appropriated from the rebuild 3 Iowa infrastructure fund for the fiscal year beginning July 1, 4 2023, and ending June 30, 2024, the sum of eighteen million 5 three hundred ninety thousand two hundred ninety dollars to the 6 technology reinvestment fund, notwithstanding section 8.57, 7 subsection 5, paragraph “c” . 8 DIVISION V 9 DESTINATION IOWA FUND 10 Sec. 10. NEW SECTION . 15.281 Destination Iowa fund. 11 1. For purposes of this section: 12 a. “Eligible applicant” means a city, county, or 13 not-for-profit organization. 14 b. “Rural community” means a community that has a population 15 of fewer than twenty thousand persons as determined by the most 16 recent population estimate produced by the United States bureau 17 of census or the most recent decennial census released by the 18 United States bureau of census. 19 c. “Vertical infrastructure” means land acquisition 20 and construction, major renovation and major repair of 21 buildings, all appurtenant structures, utilities, site 22 development, recreational trails, and water trails. “Vertical 23 infrastructure” does not include routine, recurring maintenance 24 or operational expenses or leasing of a building, appurtenant 25 structure, or utility without a lease-purchase agreement. 26 2. A destination Iowa fund is created in the state treasury 27 under the control of the authority. The fund shall consist of 28 all moneys appropriated to the fund. The board will oversee 29 and administer the destination Iowa fund. 30 3. Moneys in the destination Iowa fund are appropriated 31 to the authority for purposes of providing grants to eligible 32 applicants for any of the following types of projects: 33 a. Economically significant projects that increase tourism 34 opportunities. 35 -15- SF 577 (2) 90 ec/rh/mb 15/ 18
S.F. 577 b. Development and enhancement of outdoor recreational 1 opportunities. 2 c. Projects that contribute to quality of life in rural 3 communities. 4 4. Projects must meet all of the following criteria to be 5 eligible for a grant to an eligible applicant from the fund: 6 a. The project must be primarily vertical infrastructure. 7 b. The project must be available for year-round use by the 8 public. 9 c. An eligible applicant must intend to own the property 10 that is the subject of the project upon completion. 11 5. The board shall prioritize making awards to applicants 12 that have not been awarded money from the destination Iowa fund 13 or other programs intended to support community attraction 14 and tourism projects after July 1, 2018. The board shall 15 prioritize awarding grants to projects that include primarily 16 new construction over projects that primarily renovate or 17 replace existing facilities. The board shall not award a grant 18 in an amount exceeding fifty percent of the total cost of the 19 project. 20 6. At the beginning of each fiscal year, the authority 21 shall allocate fifty percent of the moneys available in the 22 destination Iowa fund to projects in rural communities. If 23 any portion of the moneys allocated under this subsection has 24 not been awarded by April 1 of the fiscal year for which the 25 allocation is made, the portion which has not been awarded may 26 be awarded to any eligible project in the state. If a county 27 is the applicant, a project will be deemed to be located in a 28 rural community if the geographic location of the project is in 29 or near a city that is a rural community. 30 7. Applications for grants from the destination Iowa fund 31 shall be submitted to the authority. For those applications 32 that meet the eligibility criteria described in subsection 33 4, the authority shall forward the applications and provide 34 a staff evaluation to the board. S.F. 577 incurred prior to the date of board approval of a grant are 1 ineligible for reimbursement, except the acquisition of real 2 estate. 3 8. The board shall make final funding decisions on 4 each application and may approve, deny, defer, or modify 5 applications for grants under the program. The board and the 6 authority may negotiate with applicants regarding the details 7 of projects and the amount and terms of any award. In making 8 final funding decisions pursuant to this subsection, the board 9 and the authority are exempt from chapter 17A. 10 9. If an application is approved, the authority shall enter 11 into an agreement with the applicant to provide a grant awarded 12 from the fund. 13 10. Notwithstanding section 12C.7, subsection 2, 14 interest or earnings on moneys deposited in the destination 15 Iowa fund shall be credited to the destination Iowa fund. 16 Notwithstanding section 8.33, moneys credited to the 17 destination Iowa fund shall not revert at the close of a fiscal 18 year. The authority shall not use more than five percent of 19 the moneys in the fund at the beginning of each fiscal year for 20 purposes of administrative costs and program support. 21 DIVISION VI 22 ON-STREAM IMPOUNDMENT RESTORATION 23 Sec. 11. Section 456A.33C, subsections 2, 3, and 4, Code 24 2023, are amended by striking the subsections and inserting in 25 lieu thereof the following: 26 2. The department shall establish an on-stream impoundment 27 restoration program for purposes of funding projects for the 28 maintenance, restoration, and sustainability of eligible water 29 bodies and their related watersheds from moneys appropriated to 30 the department for this purpose. 31 3. a. The department shall fund projects for eligible water 32 bodies that are designed to achieve the following goals: 33 (1) Ensure a cost-effective, positive return on investment 34 for the citizens of Iowa. 35 -17- SF 577 (2) 90 ec/rh/mb 17/ 18
S.F. 577 (2) Ensure local community commitment to watershed 1 protection. 2 (3) Ensure significant improvement in water clarity, 3 safety, and quality. 4 (4) Provide for sustainable, healthy, and functioning 5 bodies of water. 6 (5) Contribute to the department’s fish and wildlife 7 conservation plans. 8 b. The process and criteria the department shall utilize 9 to fund projects under this section shall favor proposals 10 which include nonstate matching funds of at least one dollar 11 for every dollar of state funding, and funding for watershed 12 improvement practices and participation of corresponding 13 watershed management authority. 14 -18- SF 577 (2) 90 ec/rh/mb 18/ 18
