Any moneys and premiums collected by the department 23 for workers’ compensation shall be segregated into a separate 24 workers’ compensation fund in the state treasury to be used 25 for payment of state employees’ workers’ compensation claims 26 and administrative costs. Notwithstanding section 8.33 , 27 unencumbered or unobligated moneys remaining in this workers’ 28 compensation fund at the end of the fiscal year shall not 29 revert but shall remain available for expenditure for purposes 30 of the fund in subsequent fiscal years. 31 Sec. 2. REVOLVING FUNDS. There is appropriated to the 32 department of administrative services for the fiscal year 33 beginning July 1, 2023, and ending June 30, 2024, from the 34 revolving funds designated in chapter 8A and from internal 35 -2- SF 557 (2) 90 es/ns/mb 2/ 28

STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION 4 CHARGE. For the fiscal year beginning July 1, 2023, and ending 5 June 30, 2024, the monthly per contract administrative charge 6 which may be assessed by the department of administrative 7 services shall be $2.00 per contract on all health insurance 8 plans administered by the department. 9 Sec. 4. AUDITOR OF STATE. 10 1. The department shall make all of the following 3 information available to the public as part of the department’s 4 development efforts to revise the department’s internet site: 5 (1) The number of inspections of health facilities 6 conducted by the department annually by type of service 7 provider and type of inspection. 8 (2) The total annual operations budget for the department 9 that is associated with health facilities regulation, including 10 general fund appropriations and federal contract dollars 11 received by type of service provider inspected. 12 (3) The total number of full-time equivalent positions 13 in the department that are associated with health facilities 14 regulation, to include the number of full-time equivalent 15 positions serving in a supervisory capacity, and serving as 16 surveyors, inspectors, or monitors in the field by type of 17 service provider inspected. 18 (4) Identification of state and federal survey trends, 19 cited regulations, the scope and severity of deficiencies 20 identified, and federal and state fines assessed and collected 21 concerning nursing and assisted living facilities and programs. 22 c. It is the intent of the general assembly that the 23 department continuously solicit input from health facilities 24 regulated by the department to assess and improve the 25 department’s level of collaboration and to identify new 26 opportunities for cooperation. 27 5. EMPLOYMENT APPEAL BOARD 28 a. The 1 board may expend, in addition to the amount appropriated under 2 this subsection, additional amounts as are directly billable 3 to the department under this subsection and to retain the 4 additional full-time equivalent positions as needed to conduct 5 hearings required pursuant to chapter 91C . 6 c. The employment appeal board may temporarily exceed and 7 draw more than the amount appropriated in this subsection and 8 incur a negative cash balance as long as there are receivables 9 of federal funds equal to or greater than the negative balance 10 and the amount appropriated in this subsection is not exceeded 11 at the close of the fiscal year. 12 6. However, 7 the fee can be taxed as a cost and paid by the losing party, 8 except in cases where it would impose an undue hardship or be 9 unjust under the circumstances. The moneys generated by the 10 filing fee allowed under this paragraph are appropriated to 11 the department to be used for purposes of administering the 12 division of workers’ compensation. 13 10. Notwithstanding section 20 8.39 , the department of inspections, appeals, and licensing, 21 in consultation with the department of management, may 22 reallocate moneys appropriated in this section as necessary to 23 best fulfill the needs of the department provided for in the 24 appropriation. 25 Sec. 8. DEPARTMENT OF INSPECTIONS, APPEALS, AND LICENSING 26 —— LICENSE OR REGISTRATION FEES. 27 1. For the fiscal year beginning July 1, 2023, and ending 28 June 30, 2024, the department of inspections, appeals, and 29 licensing shall collect any license or registration fees or 30 electronic transaction fees generated during the fiscal year 31 as a result of licensing and registration activities under 32 chapters 99B , 137C , 137D , and 137F . 33 2. From the fees collected by the department under this 34 section on behalf of a municipal corporation with which 35 -8- SF 557 (2) 90 es/ns/mb 8/ 28
S.F. 557 the department has an agreement pursuant to section 137F.3 , 1 through a statewide electronic licensing system operated by 2 the department, notwithstanding section 137F.6, subsection 2 , 3 the department shall remit the amount of those fees to the 4 municipal corporation for whom the fees were collected less 5 any electronic transaction fees collected by the department to 6 enable electronic payment. 7 3. From the fees collected by the department under this 8 section, other than those fees described in subsection 2, 9 the department shall deposit the amount of $800,000 into the 10 general fund of the state prior to June 30, 2024. 11 4. From the fees collected by the department under this 12 section, other than those fees described in subsections 2 and 13 3, the department shall retain the remainder of the fees for 14 the purposes of enforcing the provisions of chapters 99B , 137C , 15 137D , and 137F . Notwithstanding section 8.33 , moneys retained 16 by the department pursuant to this subsection that remain 17 unencumbered or unobligated at the close of the fiscal year 18 shall not revert but shall remain available for expenditure 19 for the purposes of enforcing the provisions of chapters 99B , 20 137C , 137D , and 137F during the succeeding fiscal year. The 21 department shall provide an annual report to the department 22 of management and the legislative services agency on fees 23 billed and collected and expenditures from the moneys retained 24 by the department in a format determined by the department 25 of management in consultation with the legislative services 26 agency. 27 Sec. 9. HOUSING TRUST FUND APPROPRIATION —— DEPARTMENT OF 28 INSPECTIONS, APPEALS, AND LICENSING. The insurance division shall use 1.00 full-time 22 equivalent positions authorized in this subsection for an 23 employee whose sole responsibility is investigating complaints 24 and notifications related to financial exploitation of eligible 25 adults. 26 d. The insurance division shall use 2.00 full-time 27 equivalent positions authorized in this subsection for 28 management, enforcement, and investigation of matters related 29 to pharmacy benefit manager programs. 30 e. Except as provided in paragraphs “b”, “c”, and “d”, 31 the insurance division may reallocate authorized full-time 32 equivalent positions as necessary to respond to accreditation 33 recommendations or requirements. 34 f. The insurance division expenditures for examination 35 -11- SF 557 (2) 90 es/ns/mb 11/ 28
S.F. 557 purposes may exceed the projected receipts, refunds, and 1 reimbursements, estimated pursuant to section 505.7, subsection 2 7, including the expenditures for retention of additional 3 personnel, if the expenditures are fully reimbursable and the 4 division first does all of the following: 5 (1) Notifies the department of management, the legislative 6 services agency, and the legislative fiscal committee of the 7 need for the expenditures. 8 (2) Files with each of the entities named in subparagraph 9 (1) the legislative and regulatory justification for the 10 expenditures, along with an estimate of the expenditures. 11 Sec. 13. Perform fire control duties pursuant to section 11 10A.511. 12 Sec. 31. NEW SECTION . 10A.507 Licensing and regulation 13 fund. 14 1. A licensing and regulation fund is created in the state 15 treasury under the control of the department of inspections, 16 appeals, and licensing. Moneys in the fund are appropriated 17 to the department to be used to fulfill the administration and 18 enforcement responsibilities of the department and boards under 19 the purview of the department under this subchapter. 20 2. The fund shall consist of moneys and fees collected by 21 the department for deposit in the fund. 22 3. Notwithstanding section 8.33, moneys in the fund 23 that remain unencumbered or unobligated at the close of the 24 fiscal year shall not revert but shall remain available for 25 expenditure for the purposes designated in succeeding fiscal 26 years. Notwithstanding section 12C.7, subsection 2, interest 27 or earnings on moneys deposited in the fund shall be credited 28 to the fund. 29 Sec. 32. Section 88A.5, Code 2023, as amended by 2023 Iowa 30 Acts, Senate File 514, section 1766, is amended to read as 31 follows: 32 88A.5 Fees to general licensing and regulation fund. 33 All fees collected by the department under the provisions 34 of this chapter shall be transmitted to the treasurer of state 35 -19- SF 557 (2) 90 es/ns/mb 19/ 28

Section 89.9, Code 2023, as amended by 2023 Iowa 3 Acts, Senate File 514, section 1797, is amended to read as 4 follows: 5 89.9 Disposal of fees. 6 All fees provided for in this chapter shall be collected 7 by the director and remitted to the treasurer of state, to 8 be deposited in the boiler and pressure vessel safety fund 9 pursuant to section 89.8 licensing and regulation fund created 10 in section 10A.507 , together with an itemized statement showing 11 the source of collection. 12 Sec. 34. Section 89A.19, Code 2023, as amended by 2023 Iowa 13 Acts, Senate File 514, section 1820, is amended by striking the 14 section and inserting in lieu thereof the following: 15 89A.19 Fees. 16 All fees collected by the director pursuant to this chapter 17 shall be remitted to the treasurer of state, to be deposited in 18 the licensing and regulation fund created in section 10A.507. 19 Sec. 35. Section 101A.12, Code 2023, as amended by 2023 20 Iowa Acts, Senate File 514, section 1550, is amended to read 21 as follows: 22 101A.12 Deposit and use of fees. 23 The fees collected by the director in issuing licenses 24 pursuant to this chapter shall be deposited in the state 25 general fund licensing and regulation fund created in section 26 10A.507 . 27 Sec. 36. Section 103.7, Code 2023, as amended by 2023 Iowa 28 Acts, Senate File 514, section 1561, is amended by striking the 29 section and inserting in lieu thereof the following: 30 103.7 Fees. 31 All licensing, examination, renewal, and inspection fees 32 under this chapter shall be deposited in the licensing and 33 regulation fund created in section 10A.507. 34 Sec. 37. Section 105.9, subsection 3, Code 2023, is amended 35 -20- SF 557 (2) 90 es/ns/mb 20/ 28

All fees collected under this chapter shall be deposited 3 in the licensing and regulation fund created in section 4 10A.507. 5 Sec. 38. Section 135.11A, subsection 1, Code 2023, as 6 amended by 2023 Iowa Acts, Senate File 514, section 1580, is 7 amended to read as follows: 8 1. Each board under chapters chapter 100C, 103, 103A, 9 105, or 147 that are is under the administrative authority 10 of the department , except the board of nursing, board of 11 medicine, dental board, and board of pharmacy, shall receive 12 administrative and clerical support from the department and 13 may not employ its own support staff for administrative and 14 clerical duties. The executive director of the board of 15 nursing, board of medicine, dental board, and board of pharmacy 16 shall be appointed pursuant to section 135.11B . 17 Sec. 39. Section 147.80, subsection 3, Code 2023, is amended 18 to read as follows: 19 3. The board of medicine, the board of pharmacy, the 20 dental board, and the board of nursing shall retain individual 21 executive officers pursuant to section 135.11B , but shall 22 make every effort to share administrative, clerical, and 23 investigative staff to the greatest extent possible . 24 Sec. 40. Section 147.82, Code 2023, as amended by 2023 25 Iowa Acts, Senate File 514, section 1624, is amended to read 26 as follows: 27 147.82 Fee retention. 28 All fees collected by a board listed in section 147.13 or by 29 the department, and fees collected pursuant to sections 124.301 30 and 147.80 and chapter 155A by the board of pharmacy, shall be 31 retained by each board or by the department deposited in the 32 licensing and regulation fund created in section 10A.507 . The 33 moneys retained by a board shall be used for any of the board’s 34 duties, including but not limited to the addition of full-time 35 -21- SF 557 (2) 90 es/ns/mb 21/ 28
S.F. 557 equivalent positions for program services and investigations. 1 Revenues retained by a board pursuant to this section shall 2 be considered repayment receipts as defined in section 8.2 . 3 Notwithstanding section 8.33 , moneys retained by a board 4 pursuant to this section are not subject to reversion to the 5 general fund of the state. 6 Sec. 41. Section 542.4, subsection 4, Code 2023, is amended 7 to read as follows: 8 4. All moneys collected by the board from fees authorized 9 to be charged by this chapter shall be received and accounted 10 for by the board and shall be paid monthly to the treasurer of 11 state for deposit in the general fund of the state licensing 12 and regulation fund created in section 10A.507 . Expenses 13 of administering this chapter shall be paid from moneys 14 appropriated to the department pursuant to section 10A.507 15 and from appropriations made by the general assembly, which 16 expenses may include but shall not be limited to the costs 17 of conducting investigations and of taking testimony and 18 procuring the attendance of witnesses before the board or its 19 committees; all legal proceedings taken under this chapter for 20 the enforcement of this chapter ; and educational programs for 21 the benefit of the public and licensees and their employees. 22 Sec. 42. Section 542B.12, Code 2023, is amended to read as 23 follows: 24 542B.12 Disposition of fees. 25 The staff shall collect and account for all fees provided 26 for by this chapter and pay the fees to the treasurer of state 27 who shall deposit the fees in the general fund of the state 28 licensing and regulation fund created in section 10A.507 . 29 Sec. 43. Section 543B.14, Code 2023, as amended by 2023 30 Iowa Acts, Senate File 514, section 1669, is amended to read 31 as follows: 32 543B.14 Fees and expenses. 33 All fees and charges collected by the real estate commission 34 under this chapter shall be paid into the general fund of the 35 -22- SF 557 (2) 90 es/ns/mb 22/ 28
S.F. 557 state, except that deposited in the licensing and regulation 1 fund created in section 10A.507. Of the moneys deposited 2 in the fund, twenty-five dollars from each real estate 3 salesperson’s license fee and each broker’s license fee shall 4 be appropriated to the department of inspections, appeals, and 5 licensing for the purpose of hiring and compensating a real 6 estate education director and regulatory compliance personnel. 7 All expenses incurred by the commission under this chapter , 8 including compensation of staff assigned to the commission, 9 shall be paid from funds appropriated for those purposes. 10 Sec. 44. Section 543D.6, subsection 2, Code 2023, as amended 11 by 2023 Iowa Acts, Senate File 514, section 1674, is amended 12 to read as follows: 13 2. All fees collected by the board shall be deposited into 14 the commerce revolving licensing and regulation fund created in 15 section 546.12 and are appropriated to the director on behalf 16 of the board 10A.507 to be used to administer this chapter , 17 including but not limited to purposes such as examinations, 18 investigations, and administrative staffing. Notwithstanding 19 section 8.33 , moneys retained by the director pursuant to this 20 section are not subject to reversion to the general fund of 21 the state. However, the appraisal management company national 22 registry fees the board collects on behalf of the appraisal 23 subcommittee as defined in section 543E.3 shall be transmitted 24 to the appraisal subcommittee in accordance with federal laws 25 and regulations. 26 Sec. 45. Section 543E.10, subsection 2, Code 2023, as 27 amended by 2023 Iowa Acts, Senate File 514, section 1685, is 28 amended to read as follows: 29 2. Except as provided in subsection 3 , all fees collected 30 under this chapter shall be deposited into the commerce 31 revolving licensing and regulation fund created in section 32 546.12 and are appropriated to the director 10A.507 to be 33 used to administer this chapter including but not limited 34 to purposes such as examinations, investigations, and 35 -23- SF 557 (2) 90 es/ns/mb 23/ 28
S.F. 557 administrative staffing. Notwithstanding section 8.33 , moneys 1 appropriated pursuant to this subsection are not subject to 2 reversion to the general fund of the state. 3 Sec. 46. Section 544A.11, subsection 2, Code 2023, is 4 amended to read as follows: 5 2. All fees shall be paid to the treasurer of state and 6 deposited in the general fund of the state licensing and 7 regulation fund created in section 10A.507 . 8 Sec. 47. Section 544B.14, subsection 2, Code 2023, is 9 amended to read as follows: 10 2. All fees shall be collected by the secretary, paid to the 11 treasurer of state , and deposited in the general fund of the 12 state licensing and regulation fund created in section 10A.507 . 13 Sec. 48. Section 544C.3, subsection 1, paragraph e, Code 14 2023, is amended to read as follows: 15 e. Establishing fees for registration as a registered 16 interior designer, renewal of registration, reinstatement of 17 registration, and for other activities of the board pertaining 18 to its duties. The fees shall be sufficient to defray the 19 costs of administering this chapter , and shall be deposited in 20 the general fund of the state licensing and regulation fund 21 created in section 10A.507 . 22 Sec. 49. Section 546.10, subsection 3, paragraph b, Code 23 2023, as amended by 2023 Iowa Acts, Senate File 514, section 24 1704, is amended by striking the paragraph. 25 Sec. 50. Section 546.10, subsection 5, Code 2023, as amended 26 by 2023 Iowa Acts, Senate File 514, section 1704, is amended 27 by striking the subsection and inserting in lieu thereof the 28 following: 29 5. All expenses required in the discharge of the duties and 30 responsibilities imposed upon the department, the director, and 31 the licensing boards by the laws of this state shall be paid 32 from moneys appropriated for those purposes. 33 Sec. 51. REPEAL. Section 89.8, Code 2023, is repealed. 34 Sec. 52. TRANSITION PROVISIONS. 35 -24- SF 557 (2) 90 es/ns/mb 24/ 28

Any unobligated and unencumbered moneys in the boiler 1 and pressure vessel safety revolving fund created in section 2 89.8, Code 2023, as of July 1, 2023, shall be transferred for 3 deposit in the licensing and regulation fund created in section 4 10A.507, as enacted by this Act. 5 2. Any unobligated and unencumbered moneys in the revolving 6 elevator safety fund created in section 89A.19, Code 2023, 7 as of July 1, 2023, shall be transferred for deposit in the 8 licensing and regulation fund created in section 10A.507, as 9 enacted by this Act. 10 3. Any unobligated and unencumbered moneys in the 11 electrician and installer licensing and inspection fund created 12 in section 103.7, Code 2023, as of July 1, 2023, shall be 13 transferred for deposit in the licensing and regulation fund 14 created in section 10A.507, as enacted by this Act. 15 4. Any unobligated and unencumbered moneys retained by any 16 board or the department of public health for the bureau of 17 professional licensure pursuant to section 147.82, Code 2023, 18 as of July 1, 2023, shall be transferred for deposit in the 19 licensing and regulation fund created in section 10A.507, as 20 enacted by this Act. 21 5. All fees collected under chapters 543D and 543E and 22 deposited into the department of commerce revolving fund 23 created in section 546.12, Code 2023, as of July 1, 2023, shall 24 be transferred for deposit in the licensing and regulation fund 25 created in section 10A.507, as enacted by this Act. 26 DEPARTMENT OF REVENUE 27 IOWA LOTTERY DIVISION 28 MAJOR PROCUREMENT CONTRACTS 29 Sec. 53. Section 99G.3, subsection 18, Code 2023, as amended 30 by 2023 Iowa Acts, Senate File 514, section 2300, is amended 31 to read as follows: 32 18. “Vendor” means a person who provides or proposes to 33 provide goods or services to the department pursuant to a major 34 procurement contract, but does not include an employee of the 35 -25- SF 557 (2) 90 es/ns/mb 25/ 28
S.F. 557 department under this chapter, a retailer, or a state agency or 1 instrumentality thereof. 2 Sec. 54. Section 99G.8, subsection 13, Code 2023, as amended 3 by 2023 Iowa Acts, Senate File 514, section 2309, is amended 4 to read as follows: 5 13. Board members shall not have any direct or indirect 6 interest in an undertaking that puts their personal interest 7 in conflict with that of the department under this chapter 8 including but not limited to an interest in a major procurement 9 contract or a participating retailer. 10 Sec. 55. Section 99G.9, subsection 2, Code 2023, as amended 11 by 2023 Iowa Acts, Senate File 514, section 2313, is amended 12 to read as follows: 13 2. Approve, disapprove, amend, or modify the terms of major 14 lottery procurements recommended by the administrator. 15 Sec. 56. Section 99G.22, subsections 1, 3, 4, and 6, Code 16 2023, as amended by 2023 Iowa Acts, Senate File 514, section 17 2324, are amended to read as follows: 18 1. The department shall investigate the financial 19 responsibility, security, and integrity of any lottery system 20 vendor who is a finalist in submitting a bid, proposal, or 21 offer as part of a major procurement contract. Before a major 22 procurement contract is awarded, the division of criminal 23 investigation of the department of public safety shall conduct 24 a background investigation of the vendor to whom the contract 25 is to be awarded. The administrator shall consult with the 26 division of criminal investigation and shall provide for the 27 scope of the background investigation and due diligence to 28 be conducted in connection with major procurement contracts. 29 At the time of submitting a bid, proposal, or offer to the 30 department on a major procurement contract, each vendor shall 31 be required to submit to the division of criminal investigation 32 appropriate investigation authorization to facilitate this 33 investigation, together with an advance of funds to meet the 34 anticipated investigation costs. If the division of criminal 35 -26- SF 557 (2) 90 es/ns/mb 26/ 28
S.F. 557 investigation determines that additional funds are required 1 to complete an investigation, the vendor will be so advised. 2 The background investigation by the division of criminal 3 investigation may include a national criminal history check 4 through the federal bureau of investigation. The screening 5 of vendors or their employees through the federal bureau of 6 investigation shall be conducted by submission of fingerprints 7 through the state criminal history repository to the federal 8 bureau of investigation. 9 3. A major procurement contract shall not be entered into 10 with any lottery system vendor who has not complied with 11 the disclosure requirements described in this section , and 12 any contract with such a vendor is voidable. Any contract 13 with a vendor that does not comply with the requirements for 14 periodically updating such disclosures during the tenure of 15 the contract as may be specified in such contract may be 16 terminated. The provisions of this section shall be construed 17 broadly and liberally to achieve the ends of full disclosure 18 of all information necessary to allow for a full and complete 19 evaluation by the department of the competence, integrity, 20 background, and character of vendors for major procurements. 21 4. A major procurement contract shall not be entered into 22 with any vendor who has been found guilty of a felony related 23 to the security or integrity of the lottery in this or any 24 other jurisdiction. 25 6. If, based on the results of a background investigation, 26 the department determines that the best interests of the 27 department, including but not limited to the department’s 28 reputation for integrity, would be served thereby, the 29 department may disqualify a potential vendor from contracting 30 with the department for a major procurement contract or from 31 acting as a subcontractor in connection with a contract for a 32 major procurement contract. 33 Sec. 57. Section 99G.37, Code 2023, as amended by 2023 34 Iowa Acts, Senate File 514, section 2343, is amended to read 35 -27- SF 557 (2) 90 es/ns/mb 27/ 28
S.F. 557 as follows: 1 99G.37 Competitive bidding Major procurement contracts . 2 All major procurement contracts under this chapter must 3 be competitively bid entered into in accordance with chapter 4 8A, subchapter III, part 2. Procurement Major procurement 5 contracts shall take into consideration the greatest integrity 6 for the Iowa lottery. In any bidding process, the services 7 of the department of administrative services shall may be 8 utilized. 9 Sec. 58. Section 99G.39, subsection 1, Code 2023, as amended 10 by 2023 Iowa Acts, Senate File 514, section 2345, is amended 11 to read as follows: 12 1. Upon receipt of any revenue from lottery games , the 13 director shall deposit the moneys in the lottery fund created 14 pursuant to section 99G.40 . At least fifty percent of the 15 projected annual revenue accruing from the sale of tickets 16 or shares shall be allocated for payment of prizes to the 17 holders of winning tickets. After the payment of prizes, the 18 expenses of conducting the lottery shall be deducted from the 19 department’s revenue under this chapter prior to disbursement. 20 Expenses for advertising production and media purchases shall 21 not exceed four percent of the department’s gross revenue under 22 this chapter for the year. 23 Sec. 59.
