Notwithstanding section 8.33 , moneys appropriated in 5 this subsection that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available for expenditure for the purposes designated until the 8 close of the succeeding fiscal year. 9 3. AGRICULTURAL EDUCATION 10 a. The moneys appropriated in this subsection shall be 1 used for the public purpose of providing a grant to a national 2 nonprofit organization with over 80 years of experience in 3 assisting children and adults with disabilities and special 4 needs. The moneys shall be used to support a nationally 5 recognized program that began in 1986 and has been replicated 6 in at least 30 other states, but is not available through 7 any other entity in this state, and that provides assistance 8 to farmers with disabilities in all 99 counties to allow the 9 farmers to remain in their own homes and be gainfully engaged 10 in farming through provision of agricultural worksite and home 11 modification consultations, peer support services, services 12 to families, information and referral, and equipment loan 13 services. 14 c. Notwithstanding section 8.33 , moneys appropriated in 15 this subsection that remain unencumbered or unobligated at the 16 close of the fiscal year shall not revert but shall remain 17 available for expenditure for the purposes designated until the 18 close of the succeeding fiscal year. 19 6. LOESS HILLS DEVELOPMENT AND CONSERVATION FUND 20 a. For deposit in the loess hills development and 21 conservation fund created pursuant to section 161D.2 : 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 400,000 23 b. (1) Of the amount appropriated to the loess hills 24 development and conservation fund in this subsection, $360,000 25 shall be allocated to the fund’s hungry canyons account. 26 (2) Not more than 10 percent of the moneys allocated to the 27 fund’s hungry canyons account as provided in this paragraph may 28 be used for administrative costs. 29 c. (1) Of the amount appropriated to the loess hills 30 development and conservation fund in this subsection, $40,000 31 shall be allocated to the fund’s loess hills alliance account. 32 (2) Not more than 10 percent of the moneys allocated to 33 the fund’s loess hills alliance account as provided in this 34 paragraph may be used for administrative costs. 35 -4- SF 2421 (2) 90 da/js/mb 4/ 28

CHOOSE IOWA FOOD PURCHASING PILOT PROJECT FOR 13 SCHOOLS AND SCHOOL DISTRICTS OR FOOD BANKS AND IOWA EMERGENCY 14 FEEDING ORGANIZATIONS. 15 1. There is appropriated from the general fund of the state 16 to the department of agriculture and land stewardship for the 17 fiscal year beginning July 1, 2024, and ending June 30, 2025, 18 the following amount, or so much thereof as is necessary, to be 19 used for the purposes designated: 20 For purposes of supporting a choose Iowa food purchasing 21 pilot project to assist eligible participants in purchasing 22 qualified food products: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 24 2. Except as provided in subsection 3, the department 25 shall administer the pilot project based on the farm-to-school 26 program described in chapter 190A, in which the department 27 reimburses a school or school district for the purchase of a 28 food product originating from a farm source. 29 3. The department shall administer the pilot project 30 according to all of the following: 31 a. A farm or business that owns or operates the farm 32 source shall be given a preference to participate in the pilot 33 project if the farm or business is currently participating in 34 the choose Iowa promotional program as provided in chapter 35 -5- SF 2421 (2) 90 da/js/mb 5/ 28
S.F. 2421 159, subchapter II, part 2, Code 2024. Otherwise, a farm 1 or business may participate in the pilot project if the farm 2 or business has applied to participate in the choose Iowa 3 promotional program and the department determines that the 4 application will be approved. 5 b. An eligible participant is limited to any of the 6 following: 7 (1) A public or private school or a school district, if the 8 public or private school or school district is not currently 9 participating in the farm-to-school program. 10 (2) An Iowa food bank or an Iowa emergency feeding 11 organization, recognized by the department. 12 c. A qualified food product is limited to the following: 13 (1) For a school or school district, meat and poultry, dairy 14 products other than milk, eggs, honey, and produce. 15 (2) For an Iowa food bank or Iowa emergency feeding 16 organization, meat and poultry, dairy products, eggs, honey, 17 and produce. 18 d. The department is not required to follow a requirement in 19 chapter 190A that the department determines is not practical 20 for the pilot project. 21 4. a. Of the moneys appropriated in subsection 1, not more 22 than $100,000 shall be used to reimburse schools or school 23 districts and not more than $150,000 shall be used to reimburse 24 Iowa food banks and Iowa emergency feeding organizations. 25 b. An eligible participant shall be reimbursed on a matching 26 basis with the department contributing $1 for every $1 expended 27 by the eligible participant. 28 c. (1) A school or school district shall not receive more 29 than $1,000 for participating in the pilot project. 30 (2) An Iowa food bank or Iowa emergency feeding organization 31 shall not receive more than $25,000 for participating in the 32 pilot project. 33 5. The department may use not more than 5 percent of the 34 moneys appropriated in subsection 1 to pay for the costs of 35 -6- SF 2421 (2) 90 da/js/mb 6/ 28
S.F. 2421 administering the pilot project. 1 6. Notwithstanding section 8.33, moneys appropriated in 2 subsection 1 for the fiscal year beginning July 1, 2024, 3 that remain unencumbered or unobligated at the close of the 4 fiscal year shall not revert but shall remain available for 5 expenditure for the purposes designated in subsection 1 until 6 the close of the fiscal year beginning July 1, 2026. 7 7. The department shall prepare and submit a report 8 regarding its findings and recommendations to the governor and 9 general assembly not later than January 15, 2025. 10 DIVISION II 11 DEPARTMENT OF NATURAL RESOURCES 12 Sec. 6. GENERAL FUND —— DEPARTMENT. 13 1. There is appropriated from the general fund of the state 14 to the department of natural resources for the fiscal year 15 beginning July 1, 2024, and ending June 30, 2025, the following 16 amount, or so much thereof as is necessary, to be used for the 17 purposes designated: 18 For purposes of supporting the department, including its 19 divisions, for administration, regulation, and programs; for 20 salaries, support, maintenance, and miscellaneous purposes; and 21 for not more than the following full-time equivalent positions: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,500,000 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Of the number of full-time equivalent positions 25 authorized to the department pursuant to subsection 1, 50.00 26 full-time equivalent positions shall be allocated by the 27 department for seasonal employees for purposes of providing 28 maintenance, upkeep, and sanitary services at state parks. 29 This subsection shall not impact conservation officer, park 30 ranger, or park manager positions within the department. 31 3. The department shall submit a report each quarter of 32 the fiscal year to the general assembly and the department 33 of management. The report shall describe in detail the 34 expenditure of moneys appropriated under this section to 35 -7- SF 2421 (2) 90 da/js/mb 7/ 28
S.F. 2421 support the department’s administration, regulation, and 1 programs. 2 Sec. 7. STATE FISH AND GAME PROTECTION FUND —— REGULATION 3 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 4 1. There is appropriated from the state fish and game 5 protection fund created pursuant to section 456A.17 to the 6 department of natural resources for the fiscal year beginning 7 July 1, 2024, and ending June 30, 2025, the following amount, 8 or so much thereof as is necessary, to be used for the purposes 9 designated: 10 For purposes of supporting the regulation or advancement of 11 hunting, fishing, or trapping, or the protection, propagation, 12 restoration, management, or harvest of fish or wildlife, 13 including for administration, regulation, law enforcement, and 14 programs; and for salaries, support, maintenance, equipment, 15 and miscellaneous purposes: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 49,752,093 17 2. Notwithstanding section 455A.10 , the department may use 18 the unappropriated balance remaining in the state fish and game 19 protection fund to provide for the funding of health and life 20 insurance premium payments from unused sick leave balances of 21 conservation peace officers employed in a protection occupation 22 who retire, pursuant to section 97B.49B . 23 3. Notwithstanding section 455A.10 , the department may 24 use the unappropriated balance remaining in the state fish 25 and game protection fund for the fiscal year beginning July 26 1, 2024, and ending June 30, 2025, as is necessary to fund 27 salary adjustments for departmental employees for which the 28 general assembly has made an operating budget appropriation in 29 subsection 1. 30 Sec. 8. GROUNDWATER PROTECTION FUND —— WATER QUALITY. There 31 is appropriated from the groundwater protection fund created 32 in section 455E.11 to the department of natural resources for 33 the fiscal year beginning July 1, 2024, and ending June 30, 34 2025, from those moneys that are not allocated pursuant to 35 -8- SF 2421 (2) 90 da/js/mb 8/ 28

FORESTRY HEALTH MANAGEMENT 15 a. Iowa state university of science and technology 8 shall not reduce the amount that it allocates to support the 9 college of veterinary medicine from any other source due to the 10 appropriation made in this section. 11 b. Paragraph “a” does not apply to a reduction made 12 to support the college of veterinary medicine if the same 13 percentage of reduction imposed on the college of veterinary 14 medicine is also imposed on all of Iowa state university of 15 science and technology’s budget units. 16 3. If by June 30, 2025, Iowa state university of science and 17 technology fails to allocate the moneys appropriated in this 18 section to the college of veterinary medicine in accordance 19 with this section, the moneys appropriated in this section for 20 that fiscal year shall revert to the general fund of the state. 21 Sec. 13. MANAGEMENT OF PRIVATE FORESTS. 22 1. Notwithstanding section 8.33 , moneys appropriated for 24 the fiscal year beginning July 1, 2024, in this division of 25 this Act to the department of agriculture and land stewardship 26 to provide financial assistance for the establishment of 27 permanent soil and water conservation practices that remain 28 unencumbered or unobligated at the close of the fiscal year 29 shall not revert but shall remain available for expenditure 30 for the purposes designated until the close of the fiscal year 31 beginning July 1, 2027. 32 2. The moneys appropriated in subsection 1 shall be 19 used to support projects in subwatersheds as designated by the 20 division that are part of high-priority watersheds identified 21 by the water resources coordinating council established 22 pursuant to section 466B.3 . 23 b. The moneys appropriated in subsection 1 shall be used to 24 support projects in watersheds generally, including regional 25 watersheds, as designated by the division and high-priority 26 watersheds identified by the water resources coordinating 27 council established pursuant to section 466B.3 . 28 3. In supporting projects in subwatersheds and watersheds 29 as provided in subsection 2, all of the following apply: 30 a. The demonstration projects shall utilize water quality 31 practices as described in the Iowa nutrient reduction strategy 32 as defined in section 455B.171 . 33 b. The division shall implement demonstration projects as 34 provided in paragraph “a” by providing for participation by 35 -19- SF 2421 (2) 90 da/js/mb 19/ 28
S.F. 2421 persons who hold a legal interest in agricultural land used in 1 farming. To every extent practical, the division shall provide 2 for collaborative participation by such persons who hold a 3 legal interest in agricultural land located within the same 4 subwatershed. 5 c. The division shall implement a demonstration project on 6 a cost-share basis as determined by the division. However, 7 except for edge-of-field practices, the state’s share of the 8 amount shall not exceed 50 percent of the estimated cost of 9 establishing the practice as determined by the division or 10 50 percent of the actual cost of establishing the practice, 11 whichever is less. 12 d. The demonstration projects shall be used to educate other 13 persons about the feasibility and value of establishing similar 14 water quality practices. The division shall promote field day 15 events for purposes of allowing interested persons to establish 16 water quality practices on their agricultural land. 17 e. The division shall conduct water quality evaluations 18 within supported subwatersheds. Within a reasonable period 19 after accumulating information from such evaluations, the 20 division shall create an aggregated database of water quality 21 practices. Any information identifying a person holding a 22 legal interest in agricultural land or specific agricultural 23 land shall be a confidential record under section 22.7 . 24 4. The moneys appropriated in subsection 1 shall be used 25 to support education and outreach in a manner that encourages 26 persons who hold a legal interest in agricultural land used for 27 farming to implement water quality practices, including the 28 establishment of such practices in watersheds generally, and 29 not limited to subwatersheds or high-priority watersheds. 30 5. The moneys appropriated in subsection 1 may be used 31 to contract with persons to coordinate the implementation of 32 efforts provided in this section. 33 6. The moneys appropriated in subsection 1 may be used by 34 the department to support urban soil and water conservation 35 -20- SF 2421 (2) 90 da/js/mb 20/ 28
S.F. 2421 efforts, which may include but are not limited to management 1 practices related to bioretention, landscaping, the use of 2 permeable or pervious pavement, and soil quality restoration. 3 The moneys shall be allocated on a cost-share basis as provided 4 in chapter 161A . 5 7. Notwithstanding any other provision of law to the 6 contrary, the department may use moneys appropriated in 7 subsection 1 to carry out the provisions of this section on a 8 cost-share basis in combination with other moneys available to 9 the department from a state or federal source. 10 8. Not more than 10 percent of the moneys appropriated in 11 this section may be used to pay for the costs of administering 12 and implementing the water quality initiative by the 13 department’s division of soil conservation and water quality as 14 provided in section 466B.42 and this section. 15 DIVISION VII 16 IOWA RESOURCES ENHANCEMENT AND PROTECTION —— OPEN SPACES 17 Sec. 22. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. The department shall adopt rules under chapter 17A as it 27 deems necessary or desirable to establish and administer the 28 program described in subsection 1. 29 3. The department may use not more than 5 percent of the 30 moneys appropriated in subsection 1 to pay for the costs of 31 administering the program described in subsection 1. 32 4. Notwithstanding section 8.33, moneys appropriated in 33 subsection 1 for the fiscal year beginning July 1, 2024, 34 that remain unencumbered or unobligated at the close of the 35 -24- SF 2421 (2) 90 da/js/mb 24/ 28
S.F. 2421 fiscal year shall not revert but shall remain available for 1 expenditure for the purposes designated until the close of the 2 fiscal year beginning July 1, 2026. 3 DIVISION X 4 BLUFFLANDS PROTECTION REVOLVING FUND 5 PART A 6 APPROPRIATIONS 7 Sec. 29. APPROPRIATION TO SUPPORT IOWA GEOLOGICAL SURVEY. 8 1. Notwithstanding sections 161A.80A and 161A.80B, there 9 is appropriated from the blufflands protection revolving fund 10 created in section 161A.80A to the state university of Iowa for 11 the fiscal year beginning July 1, 2024, and ending June 30, 12 2025, the following amount, or so much thereof as is necessary, 13 to be used for the purposes designated: 14 For purposes of supporting a groundwater planning and 15 resource assessment project to be administered by the Iowa 16 geological survey of the state as created pursuant to section 17 456.1: 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 250,000 19 2. The moneys appropriated in subsection 1 shall be used 20 by the Iowa geological survey to map and assess the condition 21 of this state’s aquifers. The Iowa geological survey may 22 measure the volume of groundwater that is available for various 23 uses, the current and predicted allocations of groundwater to 24 support those uses, the recharge rate for the aquifers, and 25 the development of models for budgeting this state’s water 26 resources. 27 3. Notwithstanding section 8.33, moneys transferred in 28 subsection 1 shall not revert to any fund but shall remain 29 available for the purposes designated in subsection 1. 30 Sec. 30. APPROPRIATION TO SUPPORT CHOOSE IOWA FOOD 31 PURCHASING PILOT PROJECT. 32 1. Notwithstanding sections 161A.80A and 161A.80B, there 33 is appropriated from the blufflands protection revolving fund 34 created in section 161A.80A to the department of agriculture 35 -25- SF 2421 (2) 90 da/js/mb 25/ 28
S.F. 2421 and land stewardship for the fiscal year beginning July 1, 1 2024, and ending June 30, 2025, the following amount, or so 2 much thereof as is necessary, to be used for the purposes 3 designated: 4 For purposes of supporting the choose Iowa food purchasing 5 pilot project for schools and school districts or food banks 6 and Iowa emergency feeding organizations as provided in this 7 Act: 8 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 9 2. Notwithstanding section 8.33, moneys appropriated in 10 subsection 1 shall not revert to any fund but shall remain 11 available for the purposes designated in subsection 1. 12 Sec. 31. APPROPRIATION TO SUPPORT STATE PARK AND RECREATION 13 AREAS ACCESSIBILITY. 14 1. Notwithstanding sections 161A.80A and 161A.80B, after 15 moneys have been appropriated to support purposes described 16 in this part of this division of this Act, any unobligated or 17 unencumbered moneys remaining in the blufflands protection 18 revolving fund created in section 161A.80A are appropriated to 19 the department of natural resources for purposes of increasing 20 accessibility for persons with disabilities when visiting state 21 parks and recreation areas. 22 2. Notwithstanding section 8.33, moneys appropriated in 23 subsection 1 shall not revert to any fund but shall remain 24 available for the purposes designated in subsection 1. 25 3. After moneys have been appropriated to support purposes 26 described in this part of this division of this Act, the 27 blufflands protection program created in section 161A.80A is 28 suspended and moneys shall not be expended from the blufflands 29 protection revolving fund other than to wind down existing 30 obligations and comply with section 161A.80B. 31 PART B 32 CODIFIED PROVISIONS 33 Sec. 32. Section 161A.80A, subsection 2, Code 2024, is 34 amended to read as follows: 35 -26- SF 2421 (2) 90 da/js/mb 26/ 28
S.F. 2421 2. A blufflands protection revolving fund is created in 1 the state treasury. All proceeds shall be divided into two 2 equal accounts. One account shall be used for the purchase 3 of blufflands along the Mississippi river and its tributaries 4 and the other account shall be used for the purchase of 5 blufflands along the Missouri river and its tributaries. The 6 proceeds of the revolving fund are appropriated to make loans 7 to conservation organizations which that agree to purchase 8 bluffland properties adjacent to state public lands. The 9 department of agriculture and land stewardship, in conjunction 10 with the department of natural resources, shall adopt rules 11 pursuant to chapter 17A to administer the disbursement of 12 funds. Notwithstanding section 12C.7 , interest or earnings on 13 investments made pursuant to this section or as provided in 14 section 12B.10 shall be credited to the blufflands protection 15 revolving fund. Notwithstanding section 8.33 , unobligated 16 or unencumbered funds credited to the blufflands protection 17 revolving fund shall not revert at the close of a fiscal year. 18 However, the maximum balance in the blufflands protection 19 revolving fund shall not exceed two million five hundred 20 thousand dollars. Any funds in excess of two million five 21 hundred thousand dollars shall be credited to the rebuild Iowa 22 infrastructure fund. No loan shall be made under this section 23 on or after July 1, 2025. 24 Sec. 33. Section 161A.80B, subsection 1, Code 2024, is 25 amended to read as follows: 26 1. The principal and interest from any loan made pursuant to 27 section 161A.80A , as enacted in 2015 Iowa Acts, ch 132, §45 , 28 remaining outstanding on July 1, 2025, that would have been 29 payable to the blufflands protection revolving fund created 30 in section 161A.80A , that is due shall instead be paid to the 31 division on or after July 1, 2025, pursuant to the terms of 32 the loan agreement. S.F. 2421 resources for purposes of supporting projects increasing the 1 accessibility of persons with disabilities when visiting state 2 parks and recreation areas . 3 DIVISION XI 4 MISCELLANEOUS CODE PROVISIONS 5 Sec. 34. Section 458A.2, subsection 7, Code 2024, is amended 6 to read as follows: 7 7. “Gas” means and includes all natural gas and all other 8 naturally occurring gasses or fluid hydrocarbons which that 9 are produced at the wellhead and not defined in this section 10 as oil. 11 Sec. 35. Section 458A.4, subsection 1, paragraph e, Code 12 2024, is amended to read as follows: 13 e. That the production from wells be separated into gaseous 14 and liquid hydrocarbons gasses and liquids , and that each be 15 accurately measured by the means and upon standards prescribed 16 by the department; 17 Sec. 36. Section 458A.4, subsection 6, Code 2024, is amended 18 to read as follows: 19 6. To make rules or orders for the classification of wells 20 as oil wells or dry natural gas wells; or wells drilled, or 21 to be drilled, for geological information, or as wells for 22 secondary recovery projects, or wells for the disposal of 23 highly mineralized water, brine, or other oil field wastes, or 24 wells for the storage of dry natural gas, or casinghead gas, 25 or wells for the development of reservoirs for the storage of 26 liquid petroleum gas and for the exploration and production of 27 metallic mineral resources. 28 -28- SF 2421 (2) 90 da/js/mb 28/ 28
